Underinsurance in property insurance

Abstract:

Tato bakalářská práce se věnuje problematice podpojištění v majetkovém pojištění. Úvodem do problematiky je popis aktuální situace na pojistným trhu. Je zde rovněž definován termín pojistná částka a jsou uvedené metody jejího stanovení a aktualizace. Nejprve je podpojištění a s ním spojené stanovení výše pojistného plnění v případě škody rozebráno z teoretického pohledu. Výskyt dvojího právního vykladu příslušného § 2854 je v práci představen v rámci porovnání pojistných podmínek jednotlivých pojišťoven a podpořen uvedenými příklady z praxe. Existence nesouladu ve výkladu vedlo k tomu, že Ministerstvo financí připravilo návrh na úpravu novely části Občanského zákoníku, která podpojištění definuje.

Abstract:

This bachelor's thesis is focused on the problem of underinsurance in property insurance. The introduction to the issue is a description of the current situation in the insurance market. The term sum insured is explained, and its setting and updating methods are presented. Firstly, underinsurance and the related calculation of the insurance payment amount in case of loss is analyzed theoretically. The double legal interpretation of the relevant § 2854 is presented in the thesis by comparing the insurance conditions of various insurers and supported by examples from practice. The inconsistency in interpretation has led the Ministry of Finance to prepare a proposal to change the part of the Civil Code that defines underinsurance.
