Regulation of consumer loans

Abstract:

Diplomová práce je zaměřena na právní regulaci spotřebitelských úvěrů v České republice. Cílem práce je charakterizovat spotřebitelský úvěr a jeho druhy. Dále se práce zaměřuje na rizika spojená se spotřebitelskými úvěry a způsoby jejich zajištění. Práce také zahrnuje charakteristiku poskytovatelů a zprostředkovatelů spotřebitelských úvěrů. Práce obsahuje změny, které přinesl nový zákon o spotřebitelském úvěru v rámci ochrany spotřebitele, popisuje povinnosti věřitelů vůči spotřebitelům a práva spotřebitelů v oblasti poskytování spotřebitelských úvěrů. Dalšími oblastmi, kterými se práce zabývá a které souvisí s poskytování spotřebitelských úvěrů, jsou exekuce a zadluženost domácností. Právní regulaci spotřebitelských úvěrů je v posledních letech věnována zasloužená pozornost, jsou zaváděna nová pravidla a opatření, která směřují především k účinnější ochraně spotřebitele.

Abstract:

Diploma thesis is focused on the legal regulation of consumer loans in the Czech Republic. The aim of this thesis is to characterize the consumer loan and its types. Furthermore, the thesis is focused on the risks related to consumer loans and on methods of securing these consumer loans. The thesis also includes characteristics of providers and intermediaries of consumer loans. The thesis contains changes that were introduced by the new Consumer Credit Act in regards with consumer protection, it describes obligations of the creditors towards the consumers and consumer rights in the field of consumer loans lending. Other areas, which the thesis deals with and which are related to consumer loans lending, are execution and household indebtness. In recent years, a deserved attention is being paid to legal regulation of consumer loans, new rules and measures are being introduced, that lead to more effective consumer protection.
