Pervasion of Indenpendent Music Scene into Soundtracks of Audiovisual Works and its Economical Implications

Abstract:

Práce se zabývá́ problematikou užití archivní i původní hudby v audiovizuálních dílech z producentského pohledu, a to zejména z hlediska kontrastu angažování umělců z nezávislé scény proti oslovení komerčních, zvedených umělců. Toto práce diskutuje zejména v kontextu české audiovizuální produkce s přihlédnutím k zahraniční praxi. Práce dále nastiňuje problematiku kolektivní správy autorských práv, synchronizačních výjimek, obvyklých cen za licence a vypořádávání se s tímto systémem za účelem plnohodnotné distribuce audiovizuálního díla. Dále práce definuje koncept nezávislé hudební scény, popisuje její situaci v Česku, a na modelových příkladech filmu Kobry a užovky a seriálu Semestr, ke kterým vznikly i rozhovory s jejich tvůrci, osvětluje některé další výhody plynoucí ze spolupráce s nezávislou hudební scénou pro filmové tvůrce.

Abstract:

This thesis addresses the issues of using original and archival music in audio-visual works from the producer’s perspective, focusing on the contrast between engaging artists from indie scenes and commercial established artists. This is discussed primarily in the context of Czech audio-visual production taking into consideration some foreign practice. The thesis also outlines the issues of collective administration of copyright, synchronization exceptions, standard fees for licensing and copyright clearance with the objective of fully-fledged distribution of an audio-visual work. Furthermore, it defines the concept of an indie music scene, describes its situation in Czechia, and presents two case studies – Kobry a užovky feature film and Semestr series including interviews with their creators, explaining further some other advantages resulting from a cooperation with the indie scene for film makers.
