Contemporary questions on problems of liability of insuranced and harmed people

Abstract:

V diplomové práci na téma „Aktuální otázky odpovědnosti pojištěných a poškozených“ je podrobněji analyzován vývoj právní úpravy v oblasti pojišťovnictví, související s ochranou pojištěných a poškozených a jejich zákonných nároků. Dále je zde zmíněn historický vývoj právní úpravy pojištění, počátky pojišťovnictví ve světě a počátky českého pojišťovnictví, které bylo částečně vymezeno až v rakouském občanském zákoníku z roku 1811 (ABGB). Československá republika pak tuto právní úpravu uceleně dokončila až v roce 1934. Podrobněji je zde probrána úprava pojišťovnictví od roku 1965 do současnosti. V této části je dále specifikována podstata postižního práva s ohledem na možnost uplatnění ho ze strany pojišťoven. V závěru této práce je uvedena analýza pojistného trhu, některé důležité mezníky českého pojistného trhu a harmonizace legislativy související se zákonnou úpravou pojistného trhu a státním dozorem v pojišťovnictví. Cílem této práce bylo analyzovat problematiku odpovědnosti za škodu z hlediska pojištěnce i pojišťovatele a nároků s tím souvisejících.

Abstract:

In my thesis called „Contemporary questions on problems of liability of insured and harmed people“ I analyze emergence of legal regulations of insurance system, in connection with protection of insured as well as harmed people and their legal pretencions. In work I mention the historical emergence of legal regulations in insurance system round the world, roots and development of connected legal regulations in the czech insurance system, those were partly defined in the austrian civil code published in 1811 (ABGB). In the Czechoslovakia were these legal regulations completely finished in 1934. In the next part, legal regulations of insurance system since 1965 till today are taken in detail, the nature of sanction law is specified in terms of its claiming possibility from the side of insurance companies. In the last part of the work I analyze the insurance market, give some important dates of its development, present current harmonisation of its legislation and I mention something more about government supervision of the czech insurance system. The goal of the work is to analyze the issue of damage liability on the part of insured as well as of insurer in terms of their related pretensions.
