Compensation bonus for tax administration

Abstract:

Cílem práce je analýza právní úpravy kompenzačního bonusu jako podpory určené osobě samostatně výdělečně činné, společníkovi s. r. o. a osobě vykonávající činnost na základě dohody konané mimo pracovní poměr související s důsledky pandemie Covid-19. Za použití případů z praxe budou analyzovány jednotlivé druhy kompenzačního bonusu s důrazem na dílčí postupy správce daně při jeho rozhodovací činnosti a odchylky od standardních procesních postupů upravených daňovým řádem. Předmětem zkoumání bude soulad odchylek se zásadou zákonnosti. Zjištěné nedostatky projevující se v činnosti správce daně při procesu rozhodování o kompenzačním bonusu, včetně důvodů vedoucích k nevyplacení kompenzačního bonusu, budou srovnány s dostupnou judikaturou správních soudů interpretující základní zásady správy daní. Výsledky analýzy budou syntetizovány a vyvozeny závěry de lege ferenda.

Abstract:

The aim of the thesis is to analyse the legal regulation of the compensation bonus as a support intended for self-employed persons, partners of limited liability companies and persons performing activities on the basis of an agreement held outside the employment relationship related to the consequences of the Covid-19 pandemic. Using cases from practice, the individual types of compensation bonus will be analysed with emphasis on the partial procedures of the tax administrator in his decision-making activities and deviations from the standard procedural procedures regulated by the Tax Code. The subject of the examination will be the compliance of the deviations with the principle of legality. The identified deficiencies manifested in the tax administrator's activities in the decision-making process on the compensation bonus, including the reasons leading to the non-payment of the compensation bonus, will be compared with the available case law of administrative courts interpreting the basic principles of tax administration. The results of the analysis will be synthesised and de lege ferenda conclusions will be drawn.
