The Ground Lease

Abstract:

V této práci jsem se zabývala nájmem pozemku. Pojem nájem je ve své podstatě velice rozšířený a každý člověk se ve svém životě s tímto pojmem setkal. Ať už se jednalo o nájem pozemku, či jakýkoliv jiný nájem. Už od pradávna se vlastníci pozemků snažili, aby vytěžili co největší zisky, ať již svou prací nebo prací svých poddaných. Cesta k dnešnímu pojetí nájemního vztahu byla dlouhá. Jak vznikaly a jak se vyznačovaly dřívější vztahy k půdě, jsem uvedla v jedné z kapitol této práce. Velká část těchto užívacích vztahů byla nahrazena díky zákonu o půdě vztahem nájemním. Od začátku druhé poloviny 20. století začaly vznikat různé užívací instituty, které potlačovaly nájem jako formu vlastnického práva do pozadí. Znemožnily vlastníkům nakládat se svým majetkem dle své vůle. Vlastníci byli hodně omezováni také vládnoucím režimem. Přelom 80 a 90 let 20 století se stal mezníkem, kdy se začala vyvíjet snaha o narovnání postavení vlastníků. Dne 1. ledna 1992 vstoupil v platnost občanský zákoník, ve kterém jsou ustanovení o právní úpravě nájmu. Nájmu pozemku se dotýkají i jiné právní předpisy. Pozemek a ostatní pojmy, které s tímto tématem souvisí, jsou definovány v katastrálním zákoně. Katastrální zákon člení a rozděluje pozemky pro účely zápisu v katastru nemovitostí, proto jsem tento zákon v práci podrobně neuváděla. Díky tomuto rozdělení jsou pozemky přehledně zapsány do katastrálních map, kdy i laik po nahlédnutí do evidence katastru nemovitostí může zjistit čísla parcel a k čemu jaká parcela slouží. Existují však i další právní instituty, které se zabývají nájmem pozemku. A proto jsem se v této práci zabývala těmito právními předpisy. Z mého pohledu je množství těchto předpisů nesjednocené. Měl by být vytvořen komplexní právní předpis, který by se zaměřoval na nájem pozemku. Tato jednotná úprava by potom byla jednodušší a přehlednější. I když na druhou stranu by cesta k tomuto naplnění byla nelehká a zdlouhavá. Každý právní předpis, který se týká nájmu pozemku má své vnitřní vazby k dalším a dalším předpisům, a ty se pak různě prolínají. Zjednodušení by v tomto případě mohlo také vést ke zmatečnosti v řízeních. Občanský zákoník je vlastně jakýmsi základem pro nájemní vztahy a jeho úprava je pouze obecná. Zvláštní úpravu nesou ostatní právní instituty, které se týkají nájmu pozemku. Je velice nelehké mluvit o tom, co by bylo a nebylo pro úpravu nájemních vztahů v budoucnu lepší. S postupem času a změnou vládnoucích vrstev a různých politických režimů, se právní institut nájmu stále vyvíjí a vyvíjet bude. Teď je pouze na nás, na lidech, jak se budeme chovat k půdě, která má pro existenci života na Zemi svou zásadní funkci. Bez ní by právní institut nájmu pozemku, o kterém je tato bakalářská práce, zcela bezvýznamný.

Abstract:

In the thesis I have dealt with the hire and lease land. The concept of rent is essentially a very common and everyone in his life met with this notion. The owners of lots have tried to get the biggest profit, coming it from their own work or the work of their dependents. The way to a modern view of the tenant relationship was really long. The origins and characteristics of the previous relationships to land are being mentioned in the third chapter of the thesis. The major part of these relationships was substituted with the tenant relationship due to the land act. From the beginning of the second half of the 20th century, various institutes of rights of us have come into existence. They inhibited the hire as the form of proprietorship. They disallowed the owners to dispose with their property according to their will. The owners were also limited by the ruling regime. The turn of the 1980s and 1990s was a boundary mark. The effort to reconcile the state of the owners (in general, not only the state of the owners of the lots) was established. On January 1st 1992 the civil code of laws came into effectiveness. It contains the institution of the arrangement of hires. Except the civil code of laws, other laws deal with the hire of lots as well. The lot and other terms related to the topic are defined in the cadastral law. The cadastral law divides the lots to be registered in the land register. Thanks to this register the lots are digestedly recorded in the cadastral maps and even an outsider can find out the numbers and the function of certain lots after looking the information up in the cadastral evidence. There are also some other law institutes that deals with the hires of lots. And that is why I also mentioned these in my thesis. In my view the number of the institutes is not united. There should be a complex law institute established that would concentrate on the hires of lots. The institute then would be much simpler and lucid. On the other hand, the way to fulfil the goal would be very difficult and quite lengthy. Every law institute dealing with the hires of lots has its own attachment to other institutes. They then variously blend. The simplification could lead to the nullity in the administrations. The civil code of laws is then a fundamental part of the hiring relationships and its adaptation is only generic. The extra adaptations are carried by other institutes dealing with the hires of lots. It is then very difficult to talk about the good changes that would be best for the adaptation of the hiring relationships. As I mentioned above, the hire and ownership have their ancestors in the past. As time passed and regimes changed, the law institute of the hire is and will be still developing. It depends only on us how we will deal with the land that is essential for the life on Earth. Without it, the law institute of the hire of a lot would be irrelevant.
