Public agents criminality focusing on view to the phenomenon of corrupiton

Abstract:

Cílem bakalářské práce je popsat korupci jako negativní jev ve společnosti s uvedením informací, které úzce souvisí s touto tématikou. Základní otázky, které jsou v práci zpracovány, je uvedení základních pojmů, včetně vymezení osob veřejných činitelů a výčtu trestných činů veřejných činitelů související s korupcí. Důležitým aspektem je popsání úkolů, které vyplývají z boje proti korupci a závažné hospodářské kriminalitě, včetně boje s korupcí, které upravují mezinárodní úmluvy, dále v uvedení rysů, nových skutkových podstat v ekonomické oblasti včetně korupce. Částečně je v práci pojednáno o trestných činech veřejných činitelů s fenoménem korupce v Policii ČR. V samostatné stati se zabývám prevencí jak z hlediska mezinárodní úrovně, tak prevencí která vyplývá z Vládních programů ČR boje proti korupci, tak i prevencí z hlediska mezinárodních společenských organizací. V práci je uveden i výstup z materiálů, který jsem získala z pohovorů s pracovníky Policie ČR zabývající se bojem proti korupčním trestným činům, jejich odhalováním a objasňováním. V příloze práce jsou uvedeny trestné činy – hospodářské, finanční, jejich stav, struktura a dynamika včetně korupčních trestných činů ze zdroje Min. spravedlnosti ČR.

Abstract:

The aim of the work is to describe corruption as a negative phenomenon in the society with giving information closely related to this issue. Fundamental questions having been dealt in my work are stating the basic concepts including specification of persons of civil servants and enumeration of their crimes being connected with corruption. An important aspect is description of tasks resulting from fighting corruption and being specified by international convention, stating of features, new subject matters in the economic area including corruption. The work partly deals with crimes of civil servants connected with the phenomenon of corruption within the Police of the Czech Republic. In the individual part I deal with prevention from the perspective of the international basis as well as prevention resulting from the Czech Republic Governmental Programmes on Fighting Corruption and also prevention from the point of view of the international civic organizations. Output of materials having been obtained from interviews with employees of the Police of the Czech Republic being involved in corruption crimes their detection and clarification is given in my work. In the attachment there are given crimes – economic, financial, their state, structure and dynamics including corruption crimes from sources of Ministry of Justice of the Czech Republic.
