Administrative Discretion in the Czech Advocate Chamber Decisions on Disciplinary Sanctions and its Limits

Abstract:

Diplomová práce se věnuje správnímu uvážení v rámci sankční pravomoci uvnitř České advokátní komory. V úvodní části práce je vymezena podstata profesních samosprávných komor. Následuje pojednání o institutu správního uvážení v České republice včetně jeho vývoje. Hlavní část práce se týká realizace sankční pravomoci České advokátní komory se zaměřením na kárnou odpovědnost jejích členů a kárné řízení, v nichž je správní uvážení aplikováno. Následuje vymezení kon-krétních mezí jeho použití. Závěr je zaměřen na úvahy de lege lata a de lege ferenda.

Abstract:

The thesis deals with the administrative consideration within the im-plementation of the sanctioning power within the Czech Bar Associa-tion in connection with the definition of its limits. In the introductory part of the thesis the essence of professional self-governing chambers is defined. This is followed by a discussion of the institution of adminis-trative discretion in the Czech Republic in general terms. The main part of the thesis refers to the specifics of the sanctioning power of the Czech Bar Association with a focus on the disciplinary liability of its members and disciplinary proceedings in which administrative discre-tion is applied. This is followed by a definition of the specific limits of its application. The conclusion focuses on de lege lata and de lege feren-da considerations.
