The institute of debt relief in the Czech Republic: Will the amendment to the Insolvency Act effective from June 2019 help creditors or debtors?

Abstract:

Diplomová práce se zabývá institutem oddlužení v ČR, především pak novelou insolvenčního zákona, jejíž účinnost se datuje od 1. června 2019. Cílem práce je analyzovat změny insolvenčního zákona týkající se oddlužení a přinést ucelený pohled na fungování institutu oddlužení za nových podmínek. Smyslem diplomové práce, kromě výše zmíněného, je odpovědět na otázku, zda novela insolvenčního zákona účinná od 1. června 2019 pomůže věřitelům nebo dlužníkům. V práci je nejdříve analyzován stav a vývoj zadluženosti českých domácností a poté jsou rozebrány příčiny a důsledky vysokého zadlužení pro dlužníka a pro celou společnost. Následně jsou analyzovány změny, které novela insolvenčního zákona do fungování institutu oddlužení přináší. Práce dospěla ke zjištění, že je novela relativně vyvážená a pomůže oběma zmíněným skupinám. Novela v sobě zahrnuje prvky, které pomohou jak dlužníkům, tak věřitelům. Především pak otevírá možnost vstoupit do procesu oddlužení většímu počtu dlužníků, což ve výsledku může být bonusem jak pro dlužníky, pro věřitele, tak i pro celou společnost.

Abstract:

This thesis deals with the institute of debt relief in the Czech Republic, primarily with the amendment to the Insolvency Act, which is in effect from June 1st, 2019. The aim of this thesis is to analyse the changes of the Insolvency Act concerning debt relief and to deliver a comprehensive view of the working of the institute of debt recovery under the new conditions. The meaning of the thesis is, besides the above mentioned, to answer the question whether the amendment to the Insolvency Act effective from June 1st, 2019 helps creditors or debtors. First, the document analyses the state and development of indebtedness of Czech households. After that, the thesis covers the causes and consequences of high indebtedness for the debtors and the entire society. Afterwards, the dissertation analyses the changes that the amendment to the Insolvency Act brought into the working of the institute of debt relief. The argumentation of the dissertation concludes that the measures presented in the amendment have a relatively balanced impact and assist both groups. In fact, the amendment encompasses elements which help both the creditors and debtors. First and foremost, the amendment gives the opportunity to enter the process of debt relief to a higher number of debtors, which might produce a beneficial result for debtors, creditors and society.
