The case of genocide in Myanmar before the International Court of Justice

Abstract:

Bakalářská práce se zabývá tematikou mezinárodního práva a jeho využití v praxi. Vztahuje se především na Mezinárodní soudní dvůr, Mezinárodní trestní dvůr a univerzální právo před soudem v Argentině. První část této práce se zabývá genocidou, jak obecnou tak později i v případu genocidy na Barmě. Jedná se o shrnutí nejdůležitějších momentů v historii Barmy, které postupně vedly k událostem z roku 2016 a později i 2017, kdy mnoho členů Rohingyjské skupiny odešlo ze země. Tento případ se postupně dostal ke třem již výše vyjmenovaným soudům, kde ale každý z nich má jinou jurisdikci. Mezinárodní soudní dvůr může nařídit ukončení protiprávního jednání a odsoudit celý stát, kdežto Mezinárodní trestní soud může odsoudit pachatele trestného činu, který se odehrál na území smluvních států, v tomto případě se jedná o Bangladéš. Nakonec Argentinský soud může odsoudit podezřelé osoby za trestné činy provedené na území Barmy a tím tak doplňuje jurisdikci Mezinárodního trestního dvora.

Abstract:

The bachelor thesis deals with the topic of international law and its use in practice. It applies in particular to the International Court of Justice, the International Criminal Court, and universal law before a court in Argentina. The first part of this work deals with genocide, both in general and later in the case of the genocide in Burma. This is a summary of the most important moments in the history of Burma, which gradually led to the events of 2016 and later 2017 when many members of the Rohingya Group left the country. This case gradually reached the three courts already mentioned, but each of them has different jurisdiction. The International Court of Justice can order the cessation of an offense and convict the whole state, while the ICC can convict the perpetrator of a crime that has taken place in the territory of the Contracting States, in this case, Bangladesh. Finally, the Argentine court can convict suspects of crimes committed in Burma, thus complementing the jurisdiction of the International Criminal Court.
