Methodology of investigating robberies

Abstract:

V této diplomové práci se zabývám problematikou metodiky vyšetřování loupeží. Loupež je společností zařazena mezi nejzávažnější trestné činy, neboť je při ní proveden útok na cizí majetek a zároveň na tělesnou integritu oběti a na svobodu jejího rozhodování. V častých případech dochází k tak velké intenzitě násilí, že může mít za následek i smrt napadené osoby. Z charakteristiky loupeže vyplývá strach a pocit ohrožení u obyvatel a tímto dochází k následnému narušení normálního způsobu života společnosti. Lidé mají obavy o svůj život a majetek. Z uvedených důvodů je velmi důležité, aby docházelo k řádnému vyšetřování a objasňování těchto trestných činů a ke spravedlivému potrestání pachatelů. Důležitá je také prevence loupeží. Cílem mé diplomové práce je vytvořit ucelený a komplexní popis vyšetřování loupeží. Diplomová práce je rozdělena na teoretickou část a na část praktickou. Na začátku uvádím právní úpravu loupeže společně s komentářem, další část věnuji historickému vývoji podle jednotlivých období a porovnání loupeže od krádeže vloupáním. Zásadní pozornost věnuji kriminalistické charakteristice loupeží, loupežného přepadení. Uvádím statistiky loupeží, které využívám k potvrzení či vyvrácení praktických poznatků získaných z rozhovorů s příslušníky Policie České republiky. Zmiňuji zásady komunikace s pachatelem během loupeže a zásady, které je nutné dodržovat, když se člověk stane obětí loupežného přepadení. Diplomová práce obsahuje počáteční a následné úkony, které jsou pro kvalitní vyšetřování loupeže klíčové. V závěru teoretické části se věnuji zapojení veřejnosti do vyšetřování loupeží a prevenci loupeži. V praktické části své práce provádím zjišťování, zda se vyšetřování loupeží popsané v teoretické části liší od praxe, tedy od skutečné práce policistů České republiky, a to formou rozhovorů s policisty. Také zde uvádím doplňující otázky a diskuzi, ve které zmiňuji zjištěné rozdíly a shody.

Abstract:

In this diploma thesis I handle with the issue of robbery investigation methodology. Robbery is ranked by society as one of the most serious crimes, as it involves an attack on the property of others and at the same time on the victim's physical integrity and freedom of decision. In frequent cases, the violence is so intense that it can result into death of the victim. The characteristics of the robbery result in fear and a feeling of danger to the inhabitants, and this leads to a subsequent disruption of the normal way of life of society. People are worried about their lives and property. For these reasons, it is especially important that these crimes are thoroughly investigated and clarified and that the perpetrators are punished fairly. Important is also a prevention of robbery. The aim of my diploma thesis is to create a comprehensive and complex description of robbery investigations. The diploma thesis is divided into a theoretical part and a practical part. At the beginning, I present the legal regulation of robbery together with a commentary, the next part is devoted to the historical development according to individual periods and a comparison of robbery from burglary. I pay fundamental attention to the criminalistic characteristics of robberies, robbery. I present the statistics of robberies, which I use to confirm or refute the practical knowledge gained from interviews with members of the Police of the Czech Republic. I mention the principles of communication with the perpetrator during the robbery and the principles that must be followed when a person becomes a victim of a robbery. The diploma thesis contains initial and subsequent actions that are key to quality investigation of a robbery. At the end of the theoretical part, I focus on public involvement in robbery investigation and robbery prevention. In the practical part of my work, I find out whether the investigation of robberies described in the theoretical part differs from practice, i.e., from the actual work of police officers of the Czech Republic, in the form of interviews with police officers. I also present additional questions and a discussion in which I mention the differences and similarities found.
