Insolvency proceedings from the creditor's point of view

Abstract:

Cinová B. Insolvenční řízení z pohledu věřitele Bakalářská práce. Brno: Mendelova Univerzita v Brně, 2022 Bakalářská práce se zabývá insolvenčním řízením z pohledu věřitele. Literární část je věnována terminologii insolvenčního řízení a způsobům řešení úpadku dlužníka. V rámci podkapitoly náležitosti přihlášené pohledávky a podkapitoly postavení věřitelů a jejich pohledávek bude na základě literární rešerše definován správný postup přihlašování pohledávky včetně popisu práv a povinností věřitele. Ve vlastní práci bude dle jednotlivých fází popsán průběh insolvenčního případu dlužníka PK. Vlastní práce je věnována kapitole identifikace přínosů a rizik. V rámci mé specializace multikulturní kompetence bude popsán postup přihlašování pohledávky zahraničního věřitele. Na závěr vlastní práce bude definován pojem chráněné obydlí včetně vysvětlení metodiky výpočtu. V závěru bakalářské práce stanovím doporučení a na základě něho vyhodnotím závěr, který má za cíl navrhnout opatření pro věřitele, díky kterému by minimalizovali ekonomické ztráty.

Brno: Mendel University in Brno, 2021 The bachelor thesis deals with insolvency proceedings from the point of view of the creditor. The literary part is devoted to the terminology of insolvency proceedings and ways of solving the debtor's bankruptcy. Within the subchapter requisites of the registered claim and the subchapter the position of creditors and their claims, the correct procedure for registering a claim, including a description of the creditor's rights and obligations, will be defined on the basis of a literature search. In the course of his own work, the course of the insolvency case of the PK debtor will be described according to individual phases. The actual work is devoted to the chapter of benefit and risk identification. Within my specialization of multicultural competence, the procedure of filing a claim of a foreign creditor will be described. At the end of the thesis, the concept of sheltered housing will be defined, including an explanation of the calculation methodology. At the end of the bachelor's thesis, I set a recommendation and based on it, evaluate the conclusion, which aims to propose measures for creditors that would minimize economic losses.
