International Criminal Tribunals and The International Criminal Court

Abstract:

Bakalářská práce se zabývá Mezinárodním trestním soudem a Mezinárodními trestními tribunály. Obě tyto instituce jsou velmi důležité pro mezinárodní právní systém, jelikož trestají nejzávažnější zločiny jako: zločiny proti lidskosti, zločin agrese,válečné zločiny a genocida. MTS se od tribunálů liší tím, že není součástí společnosti národů, jelikož nebyl založen na základě rezoluce Rady bezpečnosti jako tribunály, ale na základě multilaterální smlouvy mezi státy. Ve své práci se zabývám historií mezinárodního práva, historií tribunálů i soudu. Také jsem definovala zločiny, kterými se tyto instituce zabývají. Dále se také snažím porovnat ICC a ICTY, ICTR a daké vyhodnotit jejich práci a úspěšnost.

Abstract:

International Criminal Tribunals and the International Criminal Court Tribunals and International Criminal Court are very important for an international justice as a means to punish the brutal crimes, as a genocide, war crimes, crimes against humanity and the last one which was defined last year ? act of aggression. ICTR and ICTY are part of the United Nations system, because they were estabilished by the resolution of UN Security Council. That´s the biggest different from the ICC, seeing that the ICC was estabilished by the multilateral agreement between the states which signed the Rome Statute and it isn´t a part of the United Nations system. In my work I write about the history of international law, history of tribunals and the court too. Likewise i had defined the scope of tribunals and the court and the crimes which they punish. In the last chapter i attempt to compare tribunals with the court also I evaluate their working.
