The Actual Development Trends of European International Private Law
Abstract:
Táto práca je rozdelená do dvoch častí. V prvej sa zaoberáme navhodnejším unifikačný prostriedkom pre unifikaciu v rámci európskeho medzinárodného práva súkromného. Ako najvhodnejší unifikátor sa nám javí nariadenie. V druhej časti komplexne analyzujeme návrh nariadenia o konaní o európskom platobnom rozkaze. Skúmame jeho výhody, povahu v ramci EMPS, vztah k narodnym pravnym úpravám.
Abstract:
This work deals with two main topics. In the first part we are trying to find the best consolidation instrument for unification in the European International Private Law. We are analyzing the existing possible instruments and we are coming to the conclusion, that the Regulation is the best instrument to use.
