Legalization of Home Births

Abstract:

Bakalářská práce se zabývá problematikou legalizace plánovaných domácích porodů. V první části předkládá stručnou historii porodnictví, kde se zabývá především jeho vývojem osvícenské době. Následně zkoumá kompetenci porodních asistentek – pro bakalářskou práci byla z tohoto ohledu nejdůležitější jejich právní odpovědnost a legislativní úprava jejich profese. Ve třetí části bakalářská práce předložila problematiku domácích porodů z právního hlediska. Pro závěr práce, která je pojata de lege ferenda, byla podnětná část, popisující zahraniční úpravy domácích porodů. Posledním tématem, které probírala teoretická část práce, byly nejvlivnější právní spory, týkající se domácích porodů. V praktické části byly předloženy výsledky dotazníkového šetření mezi laickými i odbornými respondenty.

Abstract:

The bachelor thesis deals with the issue of legalization of planned domestic deliveries. In the first part it presents a brief history of obstetrics, where it deals mainly with its development of the Enlightenment period. It then examines the competence of midwives - the bachelor's thesis was the most important in this respect their legal responsibility and legislative regulation of their profession. In the third part, the bachelor thesis presented the issue of domestic childbirth from the legal point of view. The conclusion of the work, which is de lege ferenda, was a stimulant part describing the foreign adaptations of domestic childbirth. The last topic discussed in the theoretical part of the thesis was the most influential legal disputes concerning domestic childbirth. In the practical part, the results of the questionnaire survey were presented among lay and professional respondents.
