Legal aspects of business cooperation between the European Union and Canada

Abstract:

Tématem diplomové práce jsou právní aspekty obchodní spolupráce mezi Evropskou unií a Kanadou se zaměřením na mezinárodní investice a investiční prostředí mezi těmito celky. Práce je rozdělena do tří hlavních kapitol. První kapitola je teoretickým úvodem do problematiky mezinárodních investic. Ve druhé kapitole je vytvořen přehled jednotlivých druhů mezinárodních investičních smluv i s příklady, a zároveň je věnován prostor jednotlivým mechanismům řešení mezinárodních investičních sporů. V rámci praktické třetí kapitoly je zanalyzována dohoda CETA (Komplexní hospodářská a obchodní dohoda mezi Kanadou na jedné straně a Evropskou Unií a jejími členskými státy na straně druhé). K analýze dochází z hlediska jak celé dohody, tak i z hlediska pouze kapitoly o investicích, a jsou zhodnoceny přínosy a rizika této dohody pro investice a investiční prostředí v Kanadě i v jednotlivých členských státech Evropské unie. Hlavním cílem této práce je posouzení dopadu investičních právních aspektů Komplexní hospodářské a obchodní dohody na podnikatelské prostředí a na podmínky pro přímé investice v Evropské unii a v Kanadě. Dílčím cílem je identifikace přínosů dohody CETA pro právní prostředí Evropské unie.

Abstract:

Topic of this thesis is the legal aspects of business cooperation between the European Union and Canada with a focus on the international investments and the investment environment between these entities. The thesis is divided into three main chapters. The first chapter is the theoretical introduction to the issue of international investments. The second chapter provides an overview of individual types of international investment contracts with examples, and at the same time is devoted to the various mechanisms of international investment dispute resolution. The practical third chapter analyzes the CETA (Comprehensive Economic and Trade Agreement between Canada, of the one part, and the European Union and its Member States, of the other part). The whole agreement is overall analyzed and the chapter about investments is analyzed in more detail with focus on possible benefits and risks for the investments and investment environment in Canada and in Member States of the European Union. The main objective of this work is to assess the impact of the investment legal aspects of the Comprehensive Economic and Trade Agreement on the business environment and the conditions for direct investment in the European Union and Canada. A partial objective is to identify the benefits of CETA to the European Union's regulatory environment.
