Factual position of the upper chambers in bicameral systems

Abstract:

The subject of the paper „Factual position of the upper chambers in bicameral systems“ is an attempt to define real influence of the upper chambers in political systems with bicameral parliaments by investigating nine upper chambers. In the first part of the work, constitutional prerogatives are compared to the actual impact into law making that the upper chambers have made. In the second part we try to identify the factors that may influence the activity of the upper chamber. At the end we conclude, that we can not establish a clear connection between constitutional prerogatives and the actual impact that the chambers have made. Also, we describe a measurable influence of congruent majorities on the activity of the upper chamber.

Abstract:

Predmetom práce „Faktické postavenie horných komôr v dvojkomorových systémoch“ je pokus o definovanie reálneho vplyvu horných komôr v politických systémoch s dvojkomorovými parlamentmi na základe skúmania aktivity deviatich horných komôr. V prvej časti práce porovnávame ústavné právomoci s reálnym zasahovaním horných komôr do legislatívneho procesu. V druhej časti práce sa pokúsime identifikovať faktory, ktoré môžu na aktivitu horných komôr vplývať. Na konci práce prichádzame k záveru, že neexistuje jasný súvis medzi predpokladanou silou a reálnymi zásahmi do legislatívy, taktiež merateľne identifikujeme súbežnosť väčšín v oboch komorách ako faktor ovplyvňujúci činnosť parlamentu.
