The right to respect of private and family life in the light of European Court of Human Rights

Abstract:

Podstatou této diplomové práce je rozvést problematiku týkající se článku 8 Evropské úmluvy o ochraně lidských práv a základních svobod (dále Úmluva). Nejprve je pojednáno ze široka o evropské úpravě ochrany lidských práv a jejího kontrolního mechanismu. Zbylá část diplomové práce se zaměřuje už pouze na článek 8 Úmluva. Nejprve z teoretického hlediska, tedy povinností států a jejich možnosti užití moderačního práva. Následuje výčet jednotlivých práv zachycených v prvním odstavci článku 8 Úmluvy. Vůči tomu, že k jednotlivým právům neexistují legální definice, uvádím nejdůležitější rozsudky v jednotlivých oblastech práva, abych se mohla k definici co nejvíce přiblížit. Doplnění těchto práv je kapitola s názvem Nové oblasti rozhodování Evropského soudu pro lidská práva v 21. století. V této kapitole je rozšířen výčet výše zmíněný práv o další, které se vyvíjí v posledním desetiletí. Nejdůležitější jsou právo na potrat a umělé oplodnění, právo na sexuální svobodu, otázka eutanazie a sledování jedince, problematika možnosti kontaktu s rodinou z vazby, přístup k lékařské péči a ochrana před nežádoucími lékařskými zásahy, problematika s aspekty otcovství a právo dítěte znát svůj původ a právo rodiče na ?vzdání se dítěte?. Tato nová práva jsou výsledkem pokroku společnosti. Diplomová práce je doplněna o trojjazyčné resumé.

Abstract:

The essence of this thesis is to elaborate issues related to Article 8 of the Convention for the protection of human rights and fundamental freedoms. First, it is discussed from a broad treatment of the European human rights protection and its control mechanism. The remaining part of the thesis has only focused on Article 8 of the Convention. At the beginning, from a theoretical point of view, therefore incumbent upon States and their potential use moderate law. The following is a list of individual rights recognized in the first paragraph of Article 8 of the Convention. Since for each individual right does not exist legal definitions, the most important judgments in the various areas of law are mentioned, in order to define them as closely as possible. The whole of these rights is described in the chapter called the new decision of the European Court of Human Rights in the 21st Century. In this chapter, the list of laws regarding the above-mentioned rights is widened with the ones developped in the last decade. The most important are the right to abortion and artificial insemination, the right to sexual freedom, the question of euthanasia and monitoring of individuals, the possibility of contact with the issue of family ties, access to medical care and protection from unwanted medical interventions, problems with aspects of fatherhood and the child's right to know their origin and right of parents to "foster the child." These new rights are the result of a progressive society. The thesis is accompanied by a trilingual resume.
