The ratio of direct and representative democracy in the constitutional system of the Czech Republic

Abstract:

Práce obsahuje základní pojmové vymezení, klasifikaci demokratického mechanismu, jeho charakteristiku a jeho diferenciaci od mechanismu autokratického. Věnuje se významu a výhodám demokracie obecně a jejím modelům z hlediska účasti obyvatelstva na výkonné moci. Charakterizuje zastupitelskou a přímou demokracii a jejich různé formy. Podrobněji se věnuje demokracii přímé a to z toho důvodu, že opravdový celospolečenský zájem o tento demokratický model a jeho fungování v několika posledních letech roste. Což lze vyvozovat i z toho, že v posledních parlamentních volbách relativně uspěli i politické strany, jejichž hlavním programovým bodem je prosazování přímé demokracie a zvýšení jejího poměru vůči nepřímé. Česká republika je zemí, která funguje na principech zastupitelské demokracie, ale již od vzniku samostatného českého státu se v ústavách objevují prvky přímé demokracie, které jsou v práci zachyceny a porovnán nejen jejich historický vývoj, ale i jejich případná zahraniční úprava. Je zde také zhodnocení možných výhod a nevýhod přímé a nepřímé demokracie, stejně tak jako jednotlivých institutů. Pokusy o integraci přímé demokracie do právního řádu stále pokračují a jsou na toto téma vedeny diskuze, které se z parlamentní půdy přesouvají na celospolečenskou úroveň. Přímá demokracie je velkou částí politiků, ale i občanů vnímána a v podstatě zužována pouze na institut referenda. Naopak je za ni vydávána možnost přímé volby prezidenta, která mezi instituty přímé demokracie nepatří. Zásadní problém je, že v ústavním pořádku České republiky zatím stále chybí zakotvení institutu celostátního referenda. Tím je myšlen především zákon o obecném referendu, který by zastřešoval jednotlivé speciální zákony, které jsou potřebné k provedení konkrétního referenda. To že tento zákon o obecném referendu není zakotven v našem právním řádu, řadí Českou republiku do malé skupinky evropských států, které tak také ještě neučinily. V České republice je zákonem upraveno místní referendum a krajské referendum, zatímco ústavní zákon o celostátním referendu je neustále přepracováván a jeho schválení provází a brzdí různé politické machinace a neshody. Řešením této situace je přijetí ústavního zákona o obecném referendu, který by společně s obecnou prováděcí normou stanovil, jak se má postupovat v obdobných případech, jako byl vstup České republiky do Evropské unie. Budoucí legislativní proces je potřeba provádět také s vědomím, že zde existuje i sociální rozměr a je tedy nutné provést výzkum těchto sociálních potřeb a analýzu tohoto celospolečenského vlivu nové právní regulace. Toto řešení je obecně platné a aplikovatelné i na případné další instituty přímé, ale i nepřímé demokracie. Je zcela nepochybné, že pro možné zavádění institutů přímé demokracie a tím zvyšování jejího poměru je inspirace v zahraničí velice důležitá, ale nemělo by docházet k pouhému kopírování. Vždyť například tolikrát uváděný švýcarský model, by beze změn u nás nemohl fungovat a to s ohledem na jinou mentalitu, ale i historické konsekvence.

Abstract:

This thesis contains basic definition and classification of democratic mechanism, his characteristics and differentiation from the mechanism of autocracy. It deals with the meaning and advantage of democracy in general, and its models with regards to participation of citizens in executive. It characterizes representative and direct democracy and their various forms. It focuses more in detail on direct democracy, mainly because the interest of the society ín this model of democracy and its function has been increasing over the past few years. It has been shown by the result of recent parlamentary election, which was relatively successful for parties that built their program on promoting direct democracy and increasing its ratio against indirect democracy. The Czech Republic is a country functioning on priciples of representative democracy, but already since the foundation of an independent Czech state, elements of direct democracy can be found in constitution laws. These elements are being studied in this thesis, with regards to their historical development and consequent foreign mutations. Advantages and disadvantages of direct and indirect democracy and their institutions are being compared and evaluated. Attempts at implementation of direct democracy into legislation are still in progress and there are numerous discussions on this topic, that originated on parlamentary ground and now are becoming a public society matter. Direct democracy is perceived by most of the politics as well as society as a synonym to referendum. Moreover, the presidential direct vote is incorrectly considered a direct democracy institution. The main problem is that the constitution law of The Czech Republic is still missing an establishment of national referendum, specifically a general referendum law that would cover specific single laws necessary for the performance of a particular referendum. The fact that this law is missing in our legal order places The Czech Republic among a small group of European states that haven't made that step yet. The law of The Czech Republic covers local and regional referendum, while the draft of national referendum constitutional law is still being rewised and its approval is being delayed due to constant political scheming and disagreement. A solution would be passing of a bill about general referendum that would, along with a general executive norm, determine the procedure in cases such as joining European Union. The future legislative process must be handled with awareness of a certain social aspect and therefore a research of social needs and analysis of the effect of the new law regulation on society is necessary. This solution is generally valid and applicable on other direct and indirect democracy institutions, as well. Without a doubt, inspiration by foreign countries is very important for implementation and promotion of direct democracy institutions but it should not be simply imitated or copied. E.g. often mentioned Swiss model would never work without adjusments, given the different mentality and historical background.
