Territorial and Temporal Jurisdiction of the International Criminal Court

Abstract:

Diplomová práce zkoumá územní a časové předpoklady výkonu pravomoci Mezinárodním trestním soudem („MTS“). Práce je rozdělena do třech kapitol. První kapitola se zabývá instituty mezinárodního práva (trestního), tj. pravomocí, působností a příslušností. V druhé a třetí kapitole se diplomant zabývá místní a časovou působnosti MTS jakožto předpoklady pro výkon obligatorní a fakultativní pravomoci vyjádřené ve čl. 12 odst. 1 a 3 a pravomoci založené předložením ze strany Rady OSN.

Abstract:

Diploma thesis deals with territorial and temporal preconditions of the exercise of the jurisdiction of the International Criminal Court („ICC“). Thesis is divided into three chapters. The first chapter deals with legal institutes such as the jurisdiction as the power of the subject, jurisdiction as the limits of this power’s scope or the jurisdiction such as the conjunction of both. In the second- and third-chapter author examines ICC’s obligatory and facultative jurisdiction under the art. 12 para. 1, 3 of the Rome Statute and its territorial and temporal preconditions provided in the art. 12 para. 2 of the Statute, as well as jurisdiction triggered by UN Security Council under the art. 13 (b).
