Substantive jurisdiction of courts in the protection of members of the Police of the Czech Republic in the position of whistleblowers

Anotácia:

Tato bakalářská práce se zabývá velmi aktuální problematikou, jakou příslušnost má soudní moc při řešení Whistleblowingu u příslušníků Policie ČR. V práci bude poukazováno na to, co je soudní moc, jaké máme soudy a jejich příslušnosti, co je whistleblowing, jakým způsobem byl řešen whistleblowing v minulosti a jakým směrem se posunul až do přítomnosti, a dále, jak je řešen whistleblowing u Policie ČR. Autorka se také zaměřuje na to, jakým způsobem se mohou u soudu příslušníci Policie Česko republiky bránit, pokud se stanou whistleblowery, jak je oznamovatel brán u soudu a jaká má práva a povinnosti. Práce se bude detailně zabývat zákony a směrnicí vztahující se k tématu. Cílem práce je zhodnotit a analyzovat problematiku věcné příslušnosti soudů při ochraně příslušníků PČR, kteří se ocitli v postavení whistleblowerů. Autorka v bakalářské práci bude používat kvalitativní metody, především kolektivní případovou studii a expertní šetření.

Abstract:

This bachelor's thesis deals with the very current issue of the jurisdiction of the judiciary when dealing with whistleblowing by members of the Police of the Czech Republic. The work will focus on what the judiciary is, what kind of courts we have and their jurisdiction, what whistleblowing is, how whistleblowing was dealt with in the past and in what direction it has moved to the present. Furthermore, how whistleblowing is dealt with by the Police of the Czech Republic. The author also focuses on how members of the Police of the Czech Republic can defend themselves in court if they become whistleblowers, how the whistleblower is treated in court and what his rights and obligations are. The work will deal in detail with laws and directives related to the topic. The aim of the work is to evaluate and analyze the issue of substantive jurisdiction of the courts in the protection of members of the PČR who have found themselves in the position of whistleblowers. In her bachelor's thesis, the author will use qualitative methods, primarily a collective case study and expert investigation.
