Recognition

Abstract:

Tématem této rigorózní práce je „Rekognice“. Cílem práce je komplexně pojednat o problematice rekognice jako důkazního prostředku v trestním řízení jak z pohledu právního, tak rovněž z pohledu kriminalistického a částečně i z psychologického. Tato rigorózní práce se zabývá kritickou analýzou tohoto významného důkazního prostředku se zaměřením na některé nejasnosti, problémy a chyby, které při realizaci důkazního prostředku nastávají. Práce nabízí nástin možných řešení vybraných problémů s návrhy, jak zlepšit právní úpravu de lege ferenda. Výzkumná otázka, která má být zodpovězena je, zda aktuální právní úprava efektivně naplňuje požadavky kladené na tento důkazní prostředek. Úvodní kapitola práce je zaměřena na problematiku dokazování, kde jsou vymezeny základní pojmy jako předmět a pramen důkazu, důkazní prostředek a důkaz. Následuje výklad o nepoužitelnosti důkazu, o absolutní a relativní neúčinnosti důkazu a okrajově je zmíněna i doktrína „plody z otráveného stromu“. Stěžejní část práce je věnována samotné rekognici. Čtenář je seznámen se základní charakteristikou a významem rekognice, s jejími jednotlivými druhy a stručně s procesem konstituování rekognice jako samostatného procesního úkonu. Velká část rigorózní práce je věnována samotnému průběhu rekognice, taktice a metodice při provádění jednotlivých druhů rekognic, což obnáší jednak přípravu rekognice, samotný akt znovupoznání a taktéž vyhodnocení a zadokumentování tohoto úkonu. Následují vybraná témata s rekognicí spjata jako „tipování“ pachatatele, agnoskace, prázdná rekognice, skrytá rekognice a rekognice za účasti osoby mladší 18 let. Podrobně je rovněž pojednáno o problematice povinnosti poznávané osoby účastnit se rekognice z pohledu zásady nemo tenetur se ipsum accusare a o přípustnosti úpravy zevnějšku poznávané osoby. Další kapitola se zabývá prováděním rekognice jako úkonu neodkladného a neopakovatelného dle ust. § 158a TŘ. Předposlední kapitola je věnována doporučením, jak minimalizovat chybnou identifikaci a jak zvýšit důkazní sílu rekognice. V závěrečné kapitole nalezneme úvahy de lege ferenda.

Abstract:

The topic of the thesis is “Recognition”. The aim of the thesis is to comprehensively deal with the issue of recognition as a means of evidence in criminal proceedings, both from legal point of view and from criminalistic point of view and also partly from a psychological point of view. This thesis deals with a critical analysis of this significant means of evidence focusing on some ambiguities, problems and drawbacks which occur during the implementation of this means of evidence. The thesis offers an outline of possible solutions of selected problems with proposals on how to improve the legislation de lege ferenda. The research question to be answered is whether the current legislation effectively meets the requirements for this means of evidence. The introductory chapter is focused on the issue of evidence, where the basic concepts are defined as the subject and source of evidence, means of evidence and evidence. The following is an explanation of the inapplicability of evidence, the absolute and relative ineffectiveness of evidence, and the doctrine of "fruits from a poisoned tree" is also marginally mentioned. The main part of the thesis is devoted to recognition itself. The reader is acquainted with the basic characteristics and meaning of recognition, with its individual types and briefly with the process of constituting recognition as a separate procedural act. A large part of the thesis is devoted to the process of recognition and tactics and methodology during the implementation of individual types of recognition, which includes both the preparation of recognition, the act of recognition and also the evaluation and documentation of this act. Selected topics related to recognition are following, such as the "tipping" of the offender, agnostication, blank line-up, hidden recognition and recognition with the participation of a person younger than 18 years old. In the thesis it is discussed in detail the issue of the obligation of the person who is supposed to be recognized to participate in recognition from the aspect of the principle of nemo tenetur se ipsum accusare and further the issue of the admissibility of the adjustment of the external appearance of the person who is supposed to be recognized. The following chapter deals with the implementation of recognition as an urgent and unrepeatable act according to the provisions of § 158a of the Criminal Code. The penultimate chapter is devoted to recommendations on how to minimize misidentification and how to increase the probative value of recognition. In the final chapter we find considerations de lege ferenda.
