The judgements of European Court with influence over value added tax and corporate tax rate

Abstract:

Svou práci jsem nazvala Rozsudky Evropského soudního dvora s vlivem na daň z přidané hodnoty a daň z příjmů právnických osob. V úvodu popisuji předmět mé práce a cíle, které si práce klade. Za cíl jsem si kladla seznámení se s rozsudky Evropského soudního dvora, jejich rozbor a porovnání s rozsudky soudů v České republice. V začátku práce popisuji daň z přidané hodnoty a daň z příjmů právnických osob v České republice a v rámci Evropského společenství. Na tento popis navazuje orientace v Evropském právním řádu a popis jednotlivých právních aktů Evropského společenství. Dále pokračuji popisem složení a činnosti Evropského soudního dvora a fází řízení před tímto soudem. Následuje popis návaznosti řízení soudů v České republice a Evropského soudního dvora. Práce poté pokračuje konkrétními rozsudky Evropského soudního dvora a soudů v České republice, včetně popisu řešeného problému, závěru soudu a mého shrnutí dané problematiky. V poslední kapitole popisuji, jaké směrnice Evropské unie měly a mají vliv na tvorbu zákonů v České republice. V závěru jsem shrnula nejvýznamnější poznatky a poučení z práce. Za nejvýznamnější považuji skutečnost, že se Česká republika zapojuje do evropské integrace i v daňové oblasti a že spěje k úplnému dodržování zákonných práv i díky rozsudkům Evropského soudního dvora.

Abstract:

I called my work The judgements of European Court with influence over value addend tax and corporate tax rate. First I describe a subject of my work and purposes that my work makes. For the main purpose I made the indentification with the judgements of the European Court of Justice, their analysis and a confrontation with the judgements of courts in the Czech republic. At the very beginning of my work I describe a value added tax and a corporate tax rate in the Czech republic and within the European community. Upon this describe concur the orientation in the European system of law and the describe of the European community single law acts. Further I describe a structure and activities of the European Court of Justice and the periods of a proceeding before this court. Next come the account of sequence proceeding courts in the Czech republic and the European Court of Justice. Hereafter is in my work the analysis of concrete European Court of Justice judgements and courts in the Czech republic, including descriptioning problem, courts peroration and my summary of that problem. At last chapter I describe which European Unions directives have had and have an effect on creation the laws in the Czech republic. At the close of my work I summarized the most considerable knowledges. The most significant is the fact, that the Czech republic is participating into the europe integration also in tax field and that moving towards the completely observance statute law with thanks of the European Court of Justice judgements.
