Charges on Gambling Machines

Abstract:

Anotace: Ve své práci jsem zaměřila na zpoplatnění výherních hracích přístrojů a videoloterijních terminálů. Vycházela jsem hlavně ze zákona č. 202/1990 Sb., o loteriích a jiných podobných hrách, ze zákona č. 565/ 1990 Sb., o místních poplatcích, ve znění pozdějších předpisů a z metodických příruček Ministerstva financí. V úvodě jsem představila několik základních pojmů, které vychází hlavně z loterního zákona. V dalších kapitolách jsem poukázala úpravu výherních hracích přístrojů a videoleterních terminálů v různých právních úpravách. Poplatky se zabývám v další části, místními správními.Ve své práci jsem uvedla příklady konkrétních měst, které se rozhodly bojovat proti hazardu, regulací počtu výherních hracích přístrojích. V průběhu práce srovnávám slovenskou právní úpravu s českou. V poslední části se zaměřuji na návrhy novel loterního zákona, které vypracovaly strany ČSSD a KDU-ČSL. Porovnávám je se platným loterním zákoně. Uvádím výhody a nevýhody jednotlivých novel. V závěru nabízím svojí koncepci úpravy loterního zákona.

Abstract:

Anotace: In my work I concentrated on introducing fees of gaming machines and video-lottery terminals. I was going especially out of the Act number 202/1990 Sb. about lotteries and other similar games, out of the Act number 565/1990 Sb. about the local taxes in the meaning of the later regulations and out of the instruction manual of Ministry of Finance. First, I introduced some basic terms which arise mainly out of the lottery law. The terms concentrate on the area of gaming machines and video-lottery terminals. In the following chapters I referred to arrangements of the gaming machines and video-lottery terminals in different civil and regulatory arrangements. I pay attention to the regulation charges in the following part where the municipal corporation can introduce charges on the basis of the law about regulation charges which levies the taxes to the municipality revenues. The municipality can introduce a local charge on the operation of the respective gaming machines and since the year 2010 the municipality can also introduce a local charge on other technical equipment which is allowed by the Ministry of Finance. In my thesis, I mentioned examples of particular cities which made the decision to fight the gambling by the control of the gaming machine numbers. In the last part of my thesis I focus on the concepts of the amending acts which were drawn up by the political parties ČSSD and KDU-ČSL. In the end of my thesis I suggest my own conception of the lottery law amending act
