Abstract:
Diplomová práce se zabývá fenoménem dispozitivnosti v českém občanském právu. Zaměřuje se na dispozitivnost jednak jako na právní princip, ale i jako na legislativni techniku rozlišení norem kogentních a dispozitivních v textu právních předpisů. Práce se též zabývá návrhy de lege ferenda ohledně zakotvení dispozitivnosti v novém občanském zákoníku.
Abstract:
The diploma thesis deals with the questions of disposition in Czech civil law. This diploma thesis is divided into four main chapters (sections). The first chapter deals with disposition as a principle from a philosophic point of view. The second chapter embraces disposition in legislative method direction.
