Alternative punishment in a context of juvenail delinquent behaviour

Abstract:

Diplomová práce je zaměřena na problematiku kriminality delikventní mládeže a ukládání alternativních trestů resp. opatření. Práce odráží odborné pohledy na tuto problematiku jak z hlediska psychologického, pedagogického, kriminologického i právního. Také se snaží analyzovat význam a dosah alternativního opatření do osobnostní roviny mladistvého provinilce. V kapitole první se zabývám vymezením pojmu delikventního chování mládeže, popisem osobnosti delikventa z pohledu jak psychologického tak i kriminologického i trestní odpovědností mládeže. Ve druhé kapitole popisuji trest a trestání z historického hlediska a dále přechod od represivní justice k restorativní s nástupem alternativních trestů. Kdy tato evoluce byla podmíněna zejména snahou nalézt efektivnější a účinnější postupy v procesu zacházení s pachateli trestné činnosti. Kapitola číslo tři vystihuje podstatu a filozofii alternativních trestů. Dále se zabývá soudnictvím nad mládeží v České republice, jenž upravuje speciální zákon, tak i diferenciací alternativních trestů. Čtvrtá kapitola líčí historii Probační a mediační služby, její strategická východiska a specifickou práci, kterou věnuje také mládeži. Pátá kapitola navazuje praktickými poznatky z probačního a resocializačního programu Právo pro každý den, která má za cíl představit jeden z programů, jenž je vytvořen speciálně pro mladistvé prvopachatele za účelem rozvoje osobnosti a jejich navrácení do bezkonfliktní společnosti. A na závěr v šesté kapitole popisuji výzkumná šetřením, kde analyzuji podstatu dopadu alternativního opatření do osobního života mladistvých. Přílohy, které jsou součástí diplomové práce současně doplňují teoretická východiska práce.

Abstract:

This diploma thesis focuses on the subject of youth offenders and alternative punishment solutions. The theoretical part is based upon professional views of the topic from psychologycal, pedagogical, criminal and legal standpoints. The thesis also determines the extent and importance of alternative punishments on a personal level for young offernders. The first chapter is concerned with the nomenclature of delinquent behaviour of young people, as well as describing the personality of the young offender from a psychological and criminological point of view. The chapter also deals with criminal responsibility of youth. In second chapter, punishment is examined from a historical angle, as well as the development of the judiciary from a repressive to a restorative system of practices, with the application of alternative punishment. This development was encouraged by the effort to find more efficient procedures in the process of dealing with those committing criminal offences. The third chapter describes the substance as well as the philosophy of alternative punishment. The judicial procedures associated with young people are governed by a special law. Alternative punishment is also discussed. Fourth chapter describes the history of The Probation and Mediation Service, whose strategic mission and specific role is also geared towards youth. Practical observations from the probation and re-socializing workshop "Právo pro každý den" (Law For Everyday) forms the substance of the fifth chapter. The workshop was created especially for first-time young offenders, with the aim of assisting personal development for their return to society. Finally, in sixth chapter, research into the effects of alternative punishments in the personal lives of young people is discussed. The appendix, which is part of this diploma thesis also supplements the theoretical basis of the work.
