Status of the professional athlete in labour relations

Abstract:

Tato diplomová práce je zaměřena na problematiku rozlišení statutu profesionálního sportovce, ať individuálních nebo týmových sportů, z pohledu pracovněprávních vztahů. Jedná se o rozlišení statutu sportovce jako zaměstnance nebo sportovce jako osoby samostatně výdělečně činné dle živnostenského zákona. Věnuje se struktuře sportovního prostředí, legislativě a působícím orgánům. Prostor je věnován také financování sportu a popisu jednotlivých dotačních titulů. Podrobněji se tato práce zaměřuje případy, které soudy rozhodovaly v oblasti ledního hokeje a fotbalu. Hlavním cílem práce je provést analýzu postavení sportu v právním systému, zanalyzovat současnou právní úpravu. Porovnat tuto právní úpravu s jinými státy a pokusit se navrhnout legislativní řešení v rámci České republiky, a to zejména přijetím Zákona o sportu, který by vymezoval potřebná a chybějící ustanovení pro jasnou odpověď na postavení sportovců v rámci pracovněprávních vztahů.

Abstract:

This thesis focuses on the issue of the distinction of the status of a professional athlete, whether in individual or team sports, from the perspective of employment relations. It is a distinction between the status of an athlete as an employee or an athlete as a self-employed person under the Trade Licensing Act. It looks at the structure of the sporting environment, legislation and operating authorities. Space is also devoted to the financing of sport and a description of the various subsidy titles. In more detail, this work focuses on cases decided by the courts in the field of ice hockey and football. The main aim of the thesis is to analyse the position of sport in the legal system, and to analyse the current legislation. To compare this legislation with other countries and to try to propose a legislative solution within the Czech Republic, in particular by adopting the Sports Act, which would define the necessary and missing provisions for a clear answer to the position of athletes in the context of labour relations.
