Benefits of Health Insurance - Comparison of Contemporary and Previous Legal Regulations

Abstract:

Tématem diplomové práce je srovnání nové a předchozí právní úpravy dávek nemocenského pojištění, tj. zejména zákona č. 187/2006 Sb., o nemocenském pojištění, ve znění pozdějších předpisů, včetně zohlednění změn k 1. 1. 2010, s předchozí právní úpravou, tj. úpravou účinnou k 31. 12. 2008. Nejprve je stručně vyložen systém práva sociálního zabezpečení a místo nemocenského pojištění v něm, právní vztahy nemocenského pojištění a sociální události, které jsou podmínkou pro vznik dávek. Jádrem práce je srovnání nové a předchozí právní úpravy obecných podmínek vzniku nároku na dávky, obecné charakteristiky, dávkového schématu, podpůrčí doby a dávkové formule jednotlivých dávek.V závěru jsou shrnuty hlavní rozdíly nové a předchozí právní úpravy, klady reformy úpravy nemocenského pojištění a přetrvávající nedostatky s případnými návrhy de lege ferenda.

Abstract:

This master thesis is concerned with comparing contemporary and previous legal regulation (means regulation after and before 1st February 2009) of benefits of health insurance. General questions, such as system of security law, the position of health insurance in this, basic legal relations in social security and social events founding claim the benefits are decribed at the beginning of the thesis. The most important part of the thesis is concerned with comparing contemporary and previous legal regulation of general characteristics of the benefits, conditions of establishment of claim the benefits, time period during which the benefits are paid and the specific calculation of amount of the benefits. The most important differences and the reform of health insurance made by Act No. 187/2006 Collection of Law, as amended, are summarized at the end of the thesis.
