Confidentiality of tax adviser

Abstract:

Disertační práce je zaměřena na problematiku mlčenlivosti daňového poradce. Profese daňového poradce se podle zákonné definice i jejího obsahu řadí mezi profese právní a povinnost mlčenlivosti tak patří mezi jednu ze základních povinností daňového poradce. Po úvodním shrnutí definice a účelu institutu mlčenlivosti v práci rozebírám nastavení povinnosti mlčenlivosti daňového poradce podle české právní úpravy a to především systém průlomů do této mlčenlivosti a to i v širších právních souvislostech. Další kapitoly věnuji srovnání mlčenlivosti a to jak vůči mlčenlivosti některých jiných profesí v České republice, především těch právních, tak i srovnání v zahraničních právních úpravách. Zároveň v rámci tohoto srovnání vyhodnocuji výsledky mezinárodního průzkumu zaměřeného na tento institut. Cílem práce je pak na základě výsledků těchto srovnání navrhnout změnu zákonné úpravy mlčenlivosti daňového poradce.

Abstract:

This doctoral thesis focuses on the confidentiality obligation of tax advisers. Under the Czech law, the profession of a tax adviser is established as one of the legal professions. This is reflected in the statutory definition of the profession and the setting of tax advisers’ rights and responsibilities which include the confidentiality obligation. The summary of the definition and the purpose of the concept of confidentiality obligation is followed by the analysis of the settings of the tax advisers’ confidentiality obligation under the Czech law – in particular the system of legal exemptions from the obligation, in a broader legal context. The following chapters include a comparison of the regulation of confidentiality obligation of tax advisers to the regulation of the obligation related to other professions, particularly other legal professions. The text also features a comparison of the Czech concept of confidentiality obligation of tax advisers to foreign concepts and regulations. The latter comparison includes the assessment of the outcome of an international survey focused on the concept. The aim of the thesis is to use the conclusions of the comparative analysis to formulate draft changes in the regulation of the confidentiality obligation.
