Fines imposed by the Court of Justice on Member States

Abstract:

Tato práce se zabývá teorií a praxí ukládání sankcí orgány Evropské unie, přičemž původcem sankce je buď Komise nebo Soudní dvůr, adresátem především členský stát, a sankce má podobu finančního postihu - buď pokuty, penále nebo snížené či odepřené dotace. Jen okrajově jsou zmíněny případy, kdy pokutovaným je právnická osoba. Evropská unie je vlastně posledním vývojovým stádiem nadstátní struktury zahrnující s postupem času stále více a více států evropského kontinentu, jejíž původ se datuje k roku 1957, kdy vstoupila v platnost Smlouva o založení evropského hospodářského společenství, a má podobu hybridu mezinárodní organizace a federálního státu, přičemž je nesporné, že s postupem času tento hybrid soustřeďováním stále více pravomocí konverguje směrem ke státní struktuře. Není naším úkolem rozklíčovat, co vlastně EU je. My se spokojíme s prostým faktem její existence, ve stručnosti popíšeme její vývoj s důrazem na předmět naší práce, tedy na justiční organizaci, kontrolu plnění závazků členských států, výkon rozhodnutí a sankční nástroje evropských institucí, především Komise a Soudních dvorů. Z pohledu sankcionování má Evropská unie společné s mezinárodní organizací to, že nemá centrální mocenské struktury, které disponují reálnou a realizovatelnou mocí. Sice zde existují unijní legislativní, exekutivní a justiční orgány s automatickou jurisdikcí nad všemi členskými státy i orgány Unie, tedy každý stát i unijní orgán může být adresátem právní povinnosti, aniž ji dobrovolně přijal, či může být žalován a rovněž není potřeba jeho souhlasu tak jako například u Mezinárodního soudního dvora v Haagu, a tím se Unie podobá více státu než mezinárodní organizaci, nicméně po stránce vlastní realizace právních závazků zde neexistuje možnost jejich nuceného výkonu. Unie postrádá vlastní soukromé exekutory, soudní vykonavatele či policii, která by mohla předvádět svědky, a tak jedinou možností, stejně jako u mezinárodní organizace, zbývá dobrovolné plnění právních závazků. Teoretickou možností stále zůstávají klasické formy vynucení unijních právních závazků formou donucení dle mezinárodního práva, jak o nich pojednáváme v následující kapitole a jakými jsou například embargo, bojkot, zadržení majetku jiného státu, blokace finančních prostředků atp. avšak to se již opět nacházíme v rovině mezinárodně právní a mimo rovinu eurounijní, které si v této práci dovolujeme odlišovat. Pro úplnost dodejme, že Evropská unie se na druhou stranu více než mezinárodní organizaci podobá státu, neboť disponuje efektivními prostředky vlastní normotvorby a jejím právním aktům automaticky ustupují všechny právní akty vydané orgány členských států. Dokonce neplatí zásada lex posterior derogat legi priori a členské státy tak žádným legálním způsobem nemohou obstruovat unijní právní akty - ba co víc, vlastní právní řády musí upravit, a to i zpětně tak, aby byly konformní s veškerým, a to i pozdějším unijním právem. Evropská unie má dále k dispozici aparát Komise a veřejnoprávních orgánů členských států, aby mohla účinně kontrolovat plnění právních závazků jak osob fyzických a právnických, tak členských států samotných. V některých záležitostech kontroly nepostačuje aparát Komise k výkonu všech dozorových prací a Komise musí využívat orgány moci výkonné v členských státech, a proto, stran kontroly, se Evropská unie nachází někde v půli cesty mezi mezinárodní organizací a státem. Abstract:

ětem této práce, proto se nyní o něm zmíníme jen stručně: Poruší-li členský stát jakoukoli povinnost, která mu vyplývá z norem práva EU a dobrovolně ji ani po upozornění dozorovým a kontrolním orgánem, kterým je v případě EU Komise, nesplní, je obvykle žalován před Soudním dvorem, který závazně rozhodne, zda k porušení došlo. Pokud tomu tak je a členský stát ani pak pod dozorem Komise svou povinnost splnit závazek nevykoná, má Evropská unie od platnosti Maastrichtské smlouvy možnost zažalovat tento stát znovu a žádat Soud o uložení finanční sankce pro nevykonání předchozího rozsudku Soudního dvora. Sankce může mít podobu jednorázové pokuty nebo periodického penále a obě mohou být uloženy současně. Jednorázová pokuta má mít trestající a odstrašující účinek, zatímco periodické penále se obvykle přičítá za každý den nesplnění prvního rozsudku a má tak motivační účinek, který má vést členský stát k urychlenému splnění jeho povinností. Před rokem 1993 Evropská společenství neměla možnost vynucovat nesplněné rozsudky Soudního dvora v podstatě jinak než politickým nátlakem, který avšak velmi často postačoval a vedl k cíli. Nicméně v nemalém počtu případů rozsudky Soudního dvora i tak zůstávaly jen na papíře a proto byla zavedena možnost soudního finančního postihu členských států za otálení s plněním rozsudků Soudního dvora, kdy to, zda první rozsudek skutečně nebyl splněn, podléhalo opět soudnímu přezkumu a výše a podoba případné následné sankce byla plně v diskreci Soudního dvora. Může být vznesena otázka, co se stane, pokud členský stát ani po druhém odsouzení nesplní svou povinnost ani nezaplatí pokutu či penále, které mu Soud předtím uložil. To se, soudě z dostupných zdrojů, zatím nestalo, avšak je nepochybné, že by muselo dojít k revizi zakládajících smluv a musela by být zavedena možnost uložení přísnější sankce, jejíž podoba by pravděpodobně odpovídala buď klasickým formám donucení mezinárodního práva jakými jsou omezení či pozastavení hlasovacího práva v orgánech unie, eventuálně vyloučení členského státu z EU, avšak v úvahu by připadala i možnosti diskriminace při redistribuci finančních prostředků z rozpočtu Unie, například v udělování účelových dotací, možná i exekuce na majetek státu nalézající se na území ostatních členských států. Diplomová práce samotná byla vypracovaná z velké většiny s pomocí anglické, a v některých případech i české databáze EUR-Lex, a jen k několika úvodním pasážím byla použita literatura.

Abstract:

This thesis deals with the theory and the reality of imposing sanctions by the institutions of the European Union where the sanction is issued either by the Commission or the Court of Justice, member states are the addressees (typically) and the imputed sanction itself has the form of a lump sum or, of a periodic penalty payment or of a reduced or denied subvention. The cases where the addressee of the sanction is a private person are dealt with only marginally, in the general sanctioning context. The European Union is actually the last evolution stage of a super-state structure that is including more and more European states with the course of time. It dates back to the year 1957 when the Treaty establishing the European Community came into force, and has the form of a hybrid between an international organization and a federal state. There is no doubt that this entity integrates more and more powers and converges towards a state form with the course of time. We are not supposed to decipher the basis of the European Union in this work and we content ourself with a simple fact of its existence, we briefly describe its history with an emphasis on the theme of our research, i.e. the judicial organization, monitoring of implementation of obligations of member states, law enforcement and sanction instruments of the European institutions, especially the Commission and the Court of Justice. Comparing the European Union with an international organization, from the sanctioning point of view, the common parts include the lack of central structures endowed with real and realizable capacities. There certainly exist legislative, executive and judicial bodies with an automatic jurisdiction over all member states and public institutions within the Union, hence every member state or every public institution can be an addressee of a legal obligation or can be sued in front of the Court of Justice without a possibility of an option, contrary to the typical practice of international courts of justice such as the International Court of Justice at the Hague. In this way, the European Union resembles more a state rather than an international organization. However, there is no possibility of a forced execution of legal obligations as far as their actual realization is concerned. The European Union lacks its own private or public executors or police that could bring by force witnesses in front of public officials. Thus, the only and the remaining possibility is the voluntary realization of legal obligations, so as it is at the international level of states and international organizations. The classical forms of enforcement of communitary legal obligations well known to the public international law such as embargos, boycotts, temporary suspensions of rights, exclusions from the union, seizure of a state's property, putting a hold of payments, blockage of financial instruments etc. are rather a purely theoretical possibility. Anyway, discussion on these international law instruments of legal force would step out of the scope of our communitary law task that we distinguish in this work. On the other hand, let us note for the sake of completeness, that the European Union resembles a state rather than an international organization since it disposes of efficient instruments of its own law-making and all legal acts issued by any national institution including governments, parliaments or courts of justice automatically subside to any legal act issued by a law-making body of the European Union. Furthermore, the principle lex posterior derogat legi priori is not in force on the EU level and thus the member states can in no way obstruct the legal acts of the Union. Moreover, every member state is obliged to bring his legal system in conformity with the legal acts issued by the European Union, even in the retroactive way. In this way, new Union legal acts automatically suspend older national legal acts irrespective of their hierarchical force. The European Union

further disposes of the staff of the Commission and of the systems of the public institutions of its member states in order it could effectively monitor, verify and supervise the realization and the implementation of the legal obligations of natural and artificial private persons on one hand, and of the member states themselves, on the other hand. The staff of the Commission is not all the times capable to monitor, verify and supervise the execution of the legal obligations and the Commission must therefore rely on the public institutions of the member states in order these task were accomplished. Therefore, as far the monitoring, verification and supervision of legal obligations are concerned, the European Union is somewhere a halfway between an international organization and a state. However, in case of a breach of obligations of the member state consisting in a refusal of cooperation with the Commission, the European Union has efficient instruments of law enforcement. The detailed description and analysis of the legal law enforcement within the scope of the European Union is the theme of this work so let us just mention the main issues in this resume: If a member state is in breach of any legal obligation that binds it on a basis of a European Union legal norm and the member state fails to fulfill such an obligation by not taking sufficient measures despite of a later warning contained in a reasoned opinion issued by the Commission, the member state may be brought before the Court of Justice by an action of the Commission. The Court examines the case and rules, whether the member state has really failed to fulfill its legal communitary obligation or not. If it is so and the member state still does not fulfill the duties imposed upon him in the judgement of the Court of Justice, the Maastricht Treaty has endowed the Commission with a right to invite the member state to submit its observations. Afterwards, if the Commission is not satisfied, it issues a reasoned opinion specifying the points on which the member state concerned has not complied with the judgment of the Court of Justice. If the member state concerned yet fails to take the necessary measures to comply with the Court's judgment within the time limit laid down by the Commission, the Commission may, again, bring the case before the Court of Justice. In so doing it shall specify the amount of the lump sum or penalty payment to be paid by the member state concerned which it considers appropriate in the circumstances. If the Court of Justice finds that the member state concerned has not complied with its judgment it may impose a lump sum or a penalty payment on it with a possibility of combination of both sanctions at one time. The lump sum is imposed to punish and to deter the member state to find itself in a breach of obligations in the future, whereas the penalty payment is usually counted on a daily basis until the eventual fulfillment of the first judgement of the Court of Justice and it should have a motivation effect that leads the member state to comply with the judgement as soon as possible. The European Communities had nearly no legal possibility to enforce the communitary law in case a member state was in breach of its obligations despite an existence of a condemning judgement of the Court of Justice before the Maastricht Treaty came into force. It was essentially left with a political pressure that, surprisingly, very often lead to a positive result and the state facing the negative judgement complied with it eventually. However, in many cases, it was not so and the member state in breach of its communitary duties negotiated with the Commission, pointed out the measures it had taken, claimed that they are sufficient and that there is no more a breach of obligations. In this way, the primary judgements were just a piece of paper and this has lead the member states to amend the Treaty establishing the European Communities by the article 228 (ex. article 171) that introduced the possibility of a secondary Commission's and a subsequent judicial review of the stage of the breach of the member state that has permitted the Court of Justice, described shortly above, to sentence the member state concerned to a financial sanction that was fully in the discretion of the Court of Justice. We may ask the question what would happen provided that the member state condemned to a financial sanction does not comply with the original judgement or refuses to pay the lump sum or the penalty payment imposed upon it by the secondary judgement of the Court of Justice. There is no evidence of such a case yet. However, it is apparent that the founding treaties would have to be re-examined and a legal possibility of imposition of more stringent sanctions would have to be allowed. The form of these sanctions would probably correspond either to classical forms of law enforcement stemming from the public international law such as restrictions or suspensions of rights of the member states within the institutions of the European Union, exclusion of the member state in question from the European Union, or the possibility of discrimination on the level of re-distribution of financial funds of the European Union, for instance at the awarding of purpose-built subventions or even executions adjudicated on a property of the member state concerned present in another member state, might be considered as appropriate.
