Administrative and Criminal Liability in Waste Management

Abstract:

Předmětem této práce je na základě teoretických poznatků a přiléhavé judikatury poskytnout ucelený a dostatečně podrobný výklad o současné právní úpravě správněprávní a trestní odpovědnosti při nakládání s odpady. Tato práce reflektuje novou právní úpravu odpadového zákona (zákon č. 541/2020 Sb.), obsahuje analýzu nové i staré odpadové legislativy v souvislosti se změnami, které nová právní úprava do správněprání odpovědnosti při nakládání s odpady přináší, zároveň jaké jsou její slabiny či naopak výhody. Součástí práce je také porovnání správněprávní odpovědnosti s trestní odpovědností s ohledem na účelnost či neúčelnost těchto dvou druhů odpovědností při nakládání s odpady, a to zejména ve vztahu trestního stíhání trestného činu neoprávněného nakládání s odpady v porovnání se správním trestáním předmětných přestupků.

Abstract:

The subject of this thesis is to provide, on the basis of theoretical knowledge and relevant case law, a comprehensive and sufficiently detailed interpretation of the current legal regulation of administrative and criminal liability in waste management. This thesis reflects the new legislation of the Waste Act (Act No. 541/2020 Coll.), the thesis contains an analysis of the new and old waste legislation in the context of the changes that the new legislation brings to the administrative liability in waste management, as well as what are its weaknesses or, on the contrary, its advantages. The thesis also includes a comparison of administrative liability with criminal liability with regard to the expediency or inexpediency of these two types of liability in waste management, especially in relation to the prosecution of the criminal offence of unauthorised waste management in comparison with the administrative punishment of the offences in question.
