Insurance market regulation and its impact on the management of insurance companies

Abstract:

Historickým mezníkem pro český pojistný trh bylo přistoupení České republiky k Evropské unii v roce 2004. Snahy o dosažení evropské kompatibility v právní úpravě pojišťovnictví vyústily v integraci dohledových orgánů nad finančním trhem do České národní banky. Práce pojednává o problematice regulace pojistného trhu a jejímu dopadu na řízení pojišťoven. Cílem regulace a dohledu v pojišťovnictví je zlepšení ochrany spotřebitele a sjednocení pravidel pro pojistné subjekty v rámci EU. Hlavním dopadem narůstající regulace na řízení pojišťoven v České republice je nutnost měnit zavedené řídící procesy, organizační struktury pojišťoven, připravovat a implementovat nové interní postupy v souladu s legislativními požadavky, vytvářet nové pracovní pozice a investovat značné finanční prostředky do informačních technologií. Vysoká míra regulace může znamenat pro pojišťovny velké riziko a může mít negativní vliv na další vývoj pojistného trhu nejen v České republice.

Abstract:

The entrance of the Czech Republic into the European Union in 2004 was a historical milestone for the Czech insurance law. Efforts to achieve european compatibility of insurance legal regulations resulted in the integration of all financial supervisors into the Czech National Bank. Thesis discuss problems of insurance market regulation and its impact on the management of insurance companies. The main goal of insurance regulation and supervision is to protect customers and to harmonize rules for insurance subjects within EU. Increasing regulation forces management of insurance companies in the Czech Republic to modify internal control processes, organizational structures, to prepare and implement new internal procedures in accordance with legislative requirements, to create new jobs and to invest large amount of money in new information technologies. High rate of regulation may be of a great risk for insurance companies and may have negative impact on further development of insurance market not only in the Czech Republic.
