Disciplinary proceedings of the members of the security forces in the light of the Article 6 ECHR

Abstract:

Diplomová práce je zaměřena na problematiku kázeňského řízení příslušníků bezpečnostních sborů ve světle článku 6 EÚLP. Cílem této diplomové práce je zjistit, zda je možné na kázeňské řízení příslušníků bezpečnostních sborů aplikovat článek 6 Úmluvy a následně zhodnotit, zdali je kázeňské řízení v právním řádu České republiky konstruováno tak, aby naplnilo atributy spravedlivého procesu. Práce je rozvržena do pěti kapitol. První kapitola obsahuje vymezení a seznámení se základními pojmy ve světle zákonných ustanovení, komentářové literatury a judikatury. V druhé kapitole je krátce nastíněno, jaké místo zaujímá Úmluva v právním řádě České republiky a judikaturou četně užívaná Engelova kritéria a s tím související aplikovatelnost článku 6 Úmluvy na pojmy kázeňský přestupek a jednání, které má znaky přestupku. Třetí kapitola nabízí bližší rozebrání aspektů práva na spravedlivý proces ve světle judikatury ESLP. Ve čtvrté kapitole jsou analyzovány nejdůležitější atributy kázeňského řízení ve světle článku 6 Úmluvy a pátá kapitola pak nastiňuje soudní přezkum s bližším exkurzem do problematiky plné jurisdikce správních soudů.

Abstract:

The thesis focuses on the issue of disciplinary proceedings of members of the security forces in the light of Article 6 of the ECHR. The aim of this thesis is to determine whether it is possible to apply Article 6 of the Convention to disciplinary proceedings of members of the security forces and then to assess whether disciplinary proceedings in the legal system of the Czech Republic are constructed in such a way as to fulfil the attributes of a fair trial. The thesis is divided into five chapters. The first chapter contains a definition and introduction to the basic concepts in the light of statutory provisions, commentary literature and case law. The second chapter briefly outlines the place of the Convention in the legal order of the Czech Republic and the Engel criteria frequently used by case law and the related applicability of Article 6 of the Convention to the concepts of disciplinary offence and conduct that has the characteristics of an offence. The third chapter offers a closer analysis of the aspects of the right to a fair trial in the light of the ECtHR case law. The fourth chapter analyses the most important attributes of disciplinary proceedings in the light of Article 6 of the Convention and the fifth chapter outlines judicial review with a closer excursus into the issue of the full jurisdiction of administrative courts.
