Anotácia:

Diplomová práce je zaměřena na kriminalistickou metodu – výslech, jeho historii a vývoj v Evropě od dob vzniku prvních lidských společenstev až po současnost. Jednotlivé části diplomové práce se zabývají historickou i současnou právní legislativou, která je spojena s prováděním výslechu. V dalších částech práce jsou popsány jednotlivé druhy, stadia a specifika výslechu. V diplomové práci jsou popsány rozdíly v metodách vedení výslechu, které jsou závislé na vyslýchaném subjektu a na jeho procesním postavení. Diplomová práce také podrobně popisuje způsoby zadokumentování výslechu a právní úpravy. V praktické části diplomové práce je provedeno porovnání úspěšnosti jednotlivých metod výslechu v časovém horizontu od vzniku lidských společenstev až po současnost. V této části práce jsou také popsány jednotlivé druhy výslechu. Hlavním cílem diplomové práce je představit výslech jako samostatnou kriminalistickou metodu, jeho historii a následný vývoj v Evropě. Vedlejším cílem je představit metody jednotlivých druhů výslechu.

Abstract:

The diploma thesis is focused on the criminalistic method - interrogation, its history and development in Europe from the time of the first human communities to the present. The particular parts of the diploma thesis deal with historical and current legal legislation, which is related to the interrogation. In the other parts of the thesis are described particular types, stages and specifics of questioning. The diploma thesis describes the differences in the methods of conducting interviews which depend on the questioned subject and its procedural status. The diploma thesis also describes in detail the ways of documenting the questioning and legal regulations. In the practical part of the thesis is the comparison of individual methods of questioning in the timeframe since the origin of human communities to the present day. This part also describes the different types of questioning. The main goal of the diploma thesis is to introduce the interrogation as a separate criminalistic method, its history and subsequent development in Europe. The secondary aim is to introduce the methods of the individual types of questioning.
