The diference between the settlement of claim from the Motor Third Party liability insurance and the all-risks insurance

Abstract:

Tato práce upozorňuje na základní odlišnosti likvidace pojistných událostí uplatněných z havarijního pojištění a povinného ručení. Vystihuje rozdílné nároky pojištěných a poškozených i problematiku amortizace. Zejména na základě rozhodnutí ústavního soudu z roku 2008. Tato práce také popisuje možnost volby uplatnění škody při pojistné události. Volby, uplatnit škodu z vlastní havarijní pojistky. Tato možnost se nejčastěji využívá u vozidel, kde je předpoklad odpočtu amortizace. Cílem je nalézt pro klienta nejschůdnější řešení pojistné události.

Abstract:

This thesis refers to basic differences of settling the claims laying from All-risks Insurance and Motor Third Party Liability Insurance. It represents different claims of Insureds and Third parties and depreciation questions as well. Especially on base of Decision of Constitutional Court from the year 2008. This thesis also describes a option of setting up a claim. The option of setting up the claim from own all-risks insurance policy. This option is most frequently applied with vehicles where is the anticipation of the depreciation deduction. The intention of this is finding the best settlement of client’s claim.
