The Legitimacy of the International Criminal Court

Abstract:

Mezinárodní trestní soud (MTS) je relativně nezávislou nadnárodní institucí s potenciálem ovlivňovat životy miliónů lidí. Tudíž zde vyvstává otázka demokratické kontroly této organizace. Představitelé liberálního institucionalismu A. Buchanan a R. O. Keohane se domnívají, že nelze aplikovat stejné principy demokracie známé z národní úrovně států, ale spíše uplatňují koncept legitimity. Autoři sestavili sadu pěti kritérií, které by měla mezinárodní organizace naplňovat a které jsem porovnala s cíly a činností MTS.

Abstract:

The International Criminal Court (ICC) is a relatively independent supranational institution with the potential to influence the lives of millions of people. Thus there arises the question of democratic control of the organization. Representatives of liberal institutionalism A. Buchanan and R. O. Keohane believe that you can not apply the same principles of democracy, known from the national level of the state, but rather apply the concept of legitimacy. The authors compiled a set of five criteria of legitimacy that the international organization should meet, which I compared with the goals and activities of the ICC.
