Philosophical and Legal Analysis of the Problem of Violence in J. Derrida

Abstract:

Práce je zaměřena na problematiku násilí 20. století u francouzského filosofa J. Derridy z filosoficko právního hlediska. Pozornost je v práci věnována zejména analýze pojmu násilí, vyobrazení násilí jakožto síly zákona a moci a vyobrazení násilí ve vztahu jednoho jedince k druhému. Velká část práce také patří autorům, kterými se Derrida zabýval a kriticky se s nimi vypořádal. Autor, jenž Derridu v postoji k problematice násilí nejsilněji ovlivnil, byl W. Benjamin. V závěru práce je nastíněn přínos Derridova myšlení pro dnešní dobu. Derridovo vymezení násilí je především ukázkou blízkosti a odlišnosti pojmu násilí v oblasti filosofie a práva. Násilí není možné chápat pouze jako fyzickou sílu jednoho vůči druhému, neboť násilí se nám projevuje vedle roviny fyzické i v rovině psychické a zejména jazykové.

Abstract:

The work deals with the issue of violence from a philosophical and legal aspect which is represented in the works of Jacques Derrida. The attention is mainly paid on the analysis of the term of violence and its image not only as a force of law and power but also within the relationships of people. A larger part of the text is also dedicated to authors who were critically dealt with by Derrida. The author who had strongly influenced Derrida´s attitude to the issue of violence was W. Benjamin. In the closing, the contribution of Derrida´s ideas to today´s world is mentioned. Derrida´s definition of violence is mainly an example of similarity and difference of this term in the field of philosophy and law. Violence cannot be understood only as physical power of an individual against another individual, as it is present not only on the physical level but also on the psychological, as well as the linguistic one.
