Abstract:

Anotace Tato práce se bude zabývat podrobným rozborem úřadu prezidenta České republiky. Teoretická část poskytuje ucelený přehled o moci výkonné v České republice, včetně vlády a jejích členů. Dále popisuje samotnou funkci prezidenta z ústavního hlediska, její historický vývoj a pravomoci. Zvláštní pozornost je věnována rozboru vybraných prezidentských pravomocí, jako je podepisování zákonů, udělování milostí a amnestií, propůjčování státních vyznamenání nebo jmenování soudců, generálů a členů bankovní rady. Práce rozebírá postavení prezidenta v ústavním systému, možnosti jeho odvolání a požadavky pro volitelnost do této funkce. Podrobně se zaměřuje na přechod od nepřímé k přímé volbě prezidenta v České republice a hodnotí výhody a nevýhody obou systémů. Historická část je věnována prezidentům z dob Československa i všem dosavadním prezidentům samostatné České republiky-Václavu Havlovi, Václavu Klausovi, Miloši Zemanovi a nově zvolenému Petru Pavlovi. Práce poskytuje ucelený vhled do fungování a významu úřadu prezidenta v českém ústavním systému.

Abstract:

Annotation This work will deal with a detailed analysis of the office of the President of the Czech Republic. The theoretical part provides a comprehensive overview of the executive power in the Czech Republic, including the government and its members. It further describes the very function of the president from a constitutional perspective, its historical development, and powers. Special attention is paid to the analysis of selected presidential powers, such as the signing of laws, granting pardons and amnesties, awarding state honors, or appointing judges, generals, and members of the banking council. The work discusses the position of the president in the constitutional system, the possibilities of his/her recall, and the requirements for eligibility for this office. It focuses in detail on the transition from indirect to direct election of the president in the Czech Republic and evaluates the advantages and disadvantages of both systems. The historical part is devoted to the presidents from the times of Czechoslovakia and all the presidents of the independent Czech Republic so far - Václav Havel, Václav Klaus, Miloš Zeman, and the newly elected Petr Pavel. The work provides a comprehensive insight into the functioning and importance of the office of the president in the Czech constitutional system.
