Employment contract (the Quality Management System in compliance with the relevant legislation)

Abstract:

The aim of Bachelor Thesis is to evaluate the exploring the relevance of Employment Contract in the Quality Management System, advantages and disadvantages of Employment Contract in comparison with the implementation of agreements executed out of employment while changing the legislation with reference to business sector. The legislation of the Slovak Republic is the subject of quite often amendments and we draw our attention to this fact in our Bachelor Thesis. We often encounter this problem in the Labour Law, the Law of Social Security and Health Insurance, while the transparency and observation of the relevant legislation is quite complicated on the employer’s side as well as the side of employee. The Bachelor Thesis specifically address the above issues, while the first chapter is devoted to the theoretical aspects of selected issue, definition of employment relationship, employment, pre-contractual relations, employment contract and agreements on work executed outside employment.The second chapter introduces the Quality Management System with focus on Human Resources and subsequently it analyzes the Employment Contract and obligations of employer in compliance with the relevant legislation in the business sector and agreements on work executed outside employment in the Quality Management System in compliance with the relevant legislation in the business sector. The third chapter brings comparison of assessment of contracts and agreements executed outside employment.

Abstract:

Cieľom bakalárskej práce je skúmanie významu pracovnej zmluvy v systéme manažérstva kvality, výhody a nevýhody pracovnej zmluvy pri komparácii s dohodami vykonávanými mimo pracovného pomeru pri zmene legislatívy s poukazom na podnikateľskú sféru. Legislatíva v Slovenskej republike je pomerne často novelizovaná, čo dávame do pozornosti v našej bakalárskej práci. V pracovnom práve, v práve sociálneho zabezpečenia a zdravotného poistenia sa často stretávame s uvedeným problémom, pričom prehľadnosť a dodržiavanie príslušnej legislatívy je pomerne komplikované na strane zamestnávateľa a zároveň aj na strane zamestnanca. Bakalárska práca sa zaoberá práve uvedenou problematikou, pričom prvá kapitola je venovaná teoretickým aspektom zvolenej problematiky, definovaniu pracovnoprávneho vzťahu, pracovného pomeru, predzmluvných vzťahov, pracovnej zmuvy a dohodám o prácach vykonávaných mimo pracovného pomeru. Druhá kapitola predstavuje systém manažérstva kvality so zameraním na ľudské zdroje a následne analyzuje pracovnú zmluvu a povinnosti zamestnávateľa v systéme manažérstva kvality pri dodržiavaní príslušnej legislatívy v podnikateľskej sfére a dohody o prácach vykonávaných mimo pracovného pomeru v systéme manažérstva kvality pri dodržiavaní príslušnej legislatívy v podnikateľskej sfére. Tretia kapitola prináša zhodnotenie komparácie pracovných zmlúv a dohôd vykonávaných mimo pracovného pomeru
