Enforcement of intellectual property rights by the Customs Administration of the Czech Republic

Abstract:

Cílem diplomové práce je zhodnotit problematiku vymáhání práv duševního vlastnictví orgány Celní správy České republiky. Diplomová práce je zaměřena na aplikovatelnost jednotlivých právních předpisů na případech v praxi a zhodnocení problematiky vymáhání práv duševního vlastnictví orgány Celní správy ČR. V diplomové práci jsou vymezeny základní pojmy týkající se práv duševního vlastnictví, popsána právní úprava týkající se řízení před orgány celní správy a citován zákon č. 355/2014 Sb., o působnosti orgánů Celní správy České republiky v souvislosti s vymáháním práv duševního vlastnictví, ve znění pozdějších předpisů. V diplomové práci jsou rovněž řešeny i ekonomické aspekty porušování práv duševního vlastnictví. Hlavním zdrojem dat pro praktickou část jsou případy řešené Celní správou ČR v souvislosti s vymáháním práv duševního vlastnictví. Dalším zdrojem dat jsou souhrnné výsledky kontrol v oblasti práv duševního vlastnictví, provedených Celní správou ČR. V závěru práce je vyhodnocena problematika vymáhání práv duševního vlastnictví.

Abstract:

The aim of the diploma thesis is to evaluate the issue of enforcement of intellectual property rights by the Customs Administration of the Czech Republic. The diploma thesis is focused on the applicability of individual legal regulations to cases in practice and evaluation of the issue of enforcement of intellectual property rights by the Customs Administration of the Czech Republic. The diploma thesis defines the basic concepts related to intellectual property rights, describes the legislation relating to proceedings before customs authorities and cites Act No. 355/2014, on the competence of customs authorities of the Czech Republic in connection with the enforcement of intellectual property rights, as amended. later regulations. The diploma thesis also addresses the economic aspects of intellectual property rights infringement. The main source of data for the practical part are cases resolved by the Customs Administration of the Czech Republic in connection with the enforcement of intellectual property rights. Another source of data is the summary results of inspections in the field of intellectual property rights carried out by the Customs Administration of the Czech Republic. At the end of the work, the issue of enforcement of intellectual property rights is evaluated.
