Abstract:

Smyslem této bakalářské práce je seznámit veřejnost nejenom se základní terminologií v oblasti insolvenčního zákona a exekučního řízení, ale zvýšit její povědomí, jak stoupající tendence zadluženosti fyzických osob (zaměstnanců) zatěžuje zaměstnavatele. Exekuční tituly nesmí být opomenuty, protože tvoří základ celého procesu a tvoří převážnou část finančních nákladů podniku na zpracování. Práce je rozdělena na čtyři části. První část je teoretická, ve které budou vysvětleny základní pojmy "exekuční příkaz, exekutor, insolvenční zákon, insolvenční rejstřík, insolvenční správce, insolvenční řízení, institut osobního bankrotu". V druhé části je popsáno plnění zákonných povinností zaměstnavatelem v insolvenčním řízení zaměstnance. Třetí část je věnována finančním dopadům na podnik se zaměstnanci v insolvenci a exekuci. Čtvrtá závěrečná část zhodnotí získané poznatky.

Abstract:

The aim of this bachelor thesis is to introduce to the public with the basic terminology in the field of insolvency law and enforcement proceedings, but also to increase public´s awareness of the increasing tendency of indebtedness of natural persons (employess) to the employer. Execution titles must not be omitted, because they form the basis of the process and constitute a major part of the company´s financial cost for processing. The thesis is divided into four parts. The first part is theoretical and explains the basic terms like "execution order, executor, insolvency law, insolvency register, insolvency administrator, insolvency proceedings, institute of personal bancruptcy". The second part describes the fulfillment of legal obligations by the employer in the insolvency proceedings of the employee. The third part deals with financial implications for the enterprise with employees in insolvency and execution. The final part will evaluate the acquired knowledges.
