Legal Interpretation of Gender Equality (Philosophical and Legal Analysis of the Problematics)

Abstract:

This dissertation deals with the issue of legal interpretation of gender equality in the case-law of the European Court of Human Rights. In particular, the author examines how does this court address gender equality from the conceptual and methodological point of view. She conducts a critical analysis of the existing approach, while she points to its shortcomings and subsequently proposes a solution to overcome them. The solution presented by the author is the elimination of gender stereotypes which she labels as both the cause and the consequence of structural discrimination against women. The thesis concludes with a chapter devoted to the international legal obligations to eliminate gender stereotyping which she uses for another critical analysis of the case-law, this time from the perspective of gender stereotyping. The aim of this thesis is to demonstrate that the European Court of Human Rights can contribute to the elimination of factual inequalities between women and men by a wisely-chosen legal methodology.

Abstract:

Dizertačná práca sa zaoberá problematikou právnej interpretácie rodovej rovnosti v judikatúre Európskeho súdu pre ľudské práva. Konkrétne v nej autorka skúma ako je rodová rovnosť z koncepčného a metodologického hľadiska riešená v jeho rozhodovacej činnosti. Prostredníctvom kritickej analýzy existujúceho prístupu poukazuje na jeho nedostatky a následne navrhuje riešenie na ich prekonanie. To autorka vidí v odstraňovaní rodových stereotypov, ktoré označuje za príčinu i následok štrukturálnej diskriminácie žien. Prácu autorka uzatvára kapitolou, v ktorej sa venuje záväzkom na odstránenie rodovej stereotypizácie a uskutočňuje ďalšiu kritickú analýzu judikatúry, tentokrát z perspektívy rodovej stereotypizácie. Cieľom tejto práce je preukázať, že vhodne zvolenou právnou metodológiou Európsky súd pre ľudské práva môže prispieť k odstraňovaniu faktických nerovností medzi ženami a mužmi.
