Abstract:

Tato práce se soustředí na pojem relevantního trhu jako jeden ze zásadních konceptů soutěžního práva. Podstatnou část tvoří rozbor samotného postupu vymezování relevantního trhu, s výčtem konkrétních metod a posouzením jejich spolehlivosti, to vše s důrazem na věcné vymezení a s ním související zastupitelnost na straně poptávky a tzv. SSNIP test. Vedle toho je rozebírán rovněž význam zmíněného vymezení, a to zvlášť pro jednotlivé typy soutěžních řízení, tj. pro posouzení jak zneužití dominantního postavení, tak dohod narušujících hospodářskou soutěž, ale i spojení soutěžitelů. To vše je rozebíráno na základě české právní úpravy, souběžně s úpravou Evropské unie, a se stručným rozborem pojetí relevantního trhu v právních úpravách Spojených států a Francie.

Abstract:

This paper is focused on the notion of relevant market as one of the crucial concepts in competition law. The greatest emphasis is placed on the market definition with a list of particular methods and their reliability appraisal, whereas the product dimension is described by far the widest way as well as the demand substituability and the SSNIP test. Furthermore the paper analyses the particular contributions of the definition to each sort of competition procedure, i.e. to abuse of a dominant position investigation, restrictive agreements investigation as well as merger appraisal. The whole analysis is based on the Czech as well as EU enactment and jurisprudence with a brief comparison of US and French view.
