Tax and Accounting Aspects of NGOs

Abstract:

Cílem diplomové práce je zhodnotit právní postavení neziskových organizací, zejména s ohledem na daňové a účetní aspekty, a vymezit je tak oproti ostatním entitám, tj. především podnikatelským. V práci je popsán daňový a účetní vývoj právní úpravy neziskových organizací, především s ohledem proběhlou rekodifikaci soukromého práva. Podrobně jsou charakterizovány nejvýznamnější odlišnosti, oproti klasickým postupům v podnikatelském sektoru, ve zdaňování a účtování nestátních neziskových organizací, které činí v praxi problémy. Závěry a zjištěné skutečnosti směřují k úvahám nad efektivnější právní úpravou.

Abstract:

The aim of this thesis is evaluating the legal status of non-profit organizations with focusing on their tax and account aspects and define them against other profit corporation. The thesis describes the evolution of accountant and tax legislation of non-profit organizations, especially with regard to recodification of private law. In details are characterized most significant differences in taxation and accounting of non-profit organization, compared to conventional processes in the business sector, that differences makes practical problems. The conclusions and facts point to reasoning for more effective regulation.
