Criminal law and Criminalistic aspects of interrogation

Abstract:

Tato bakalářská práce je psaná na téma výslechu. Na začátku mé práce rozebírám pojem výslechu, aby čtenáři bylo jasné o čem práce pojednává. Výslech jsem rozebrala nejprve z trestněprávního hlediska, kde se podrobně věnuji i výslechu svědka a obviněného, jejich právy a povinnostmi v trestním řízení. Zabývala jsem se ale také výslechem z kriminalistického hlediska, konkrétně přípravou výslechu, jednotlivými stádii výslechu, rozebrala jsem pojem výpověď a přiblížila jsem, jak se určuje věrohodnost výpovědi. Další kapitolu jsem věnovala tématice jak poznat lež podle řeči těla, tato kapitola je zajímavá i pro laiky, kteří informace mohou použít i v běžném životě. V praktické části jsem sepsala otázky, které by podle mě měly zaznít u výslechu podle jednotlivých trestných činů. Cílem této práce je přiblížit čtenářům vybranou problematiku a umožnit lepší porozumění.

Abstract:

This thesis is about interrogation. At the beggining of this work I explained concept of interrogation because I wanted to intruduce to readers what is this work about. Firstly I chose to explain criminal law aspects of interrogation, where I described interrogation of witness and accused, I described their rights and obligations in criminal procedure. I wrote about criminalistics aspects of interrogation too, specifically about the preparation of the interrogation and the individual stages of interrogation, I described the concept of statement. Next chapter is about the topic how to find out when someone is lying according to his body language. My opinion is that this chapter is really interesting even for laics, they can use this informations in normal life. In the practical part I wrote a list of questions which in my opinion should be asked in the interrogation in the specific situations and specific crimes. The aim of this work is to introduce readers to this professional issue, to enable better understanding.
