Institutes replacing detention

Abstract:

Tématem této práce jsou Instituty nahrazující vazbu. Cílem práce je představit vazbu jako takovou a získat poznatky o využívání institutů, kterými ji lze v České republice nahradit. V první části práce je rozebrán institut vazby, tedy za jakých podmínek může být obviněný vzat do vazby, jaké jsou důvody vazby, kdo o ni rozhoduje a jak probíhá její výkon. Další část práce se zaměřuje na instituty, kterými lze vazbu nahradit. Takovým institutem je peněžitá záruka, dohled probačního úředníka a písemný slib. Dále je zmíněn také elektronický monitoring, který konkrétně v České republice fungoval déle než tři roky a je zde uveden důvod, proč byla elektronická kontrola osob ukončena. V závěru této části je také stručně zmíněno nahrazení vazby ve Slovenské republice. V závěru práce je rozebráno rozhodnutí Nejvyššího soudu, které se týká nahrazení vazby. Cílem této části bylo najít vhodný judikát, na kterém je možné poukázat na skutečnosti, za jakých je reálné vazbu nahradit či nikoliv. Samotný závěr obsahuje osobní názor autorky a naleznutí okolností, díky kterým by v tomto konkrétním případě bylo možné vazbu nahradit.

Abstract:

The topic of this thesis is Institutes replacing detention. The aim of the thesis is to introduce detention as such and to gain knowledge about the use of institutes that can replace it in the Czech Republic. In the first part of the thesis the institution of detention is discussed, under what conditions an accused can be taken into detention, what are the grounds for detention, who decides on it and how it is carried out. The next part of the thesis focuses on the institutes that can be used to replace detention. Such institutes include a monetary guarantee, monitoring by a probation officer and a written promise. Electronic monitoring is also mentioned, which in the Czech Republic in particular has been in operation for more than three years, and the reason why electronic monitoring of persons was discontinued is given. The replacement of detention in the Slovak Republic is also briefly mentioned at the end of this section. The thesis concludes with a discussion of the Supreme Court's decision concerning the substitution of detention. The aim of this part was to find a suitable case law to point out the facts under which it is realistic to substitute detention or not. The conclusion itself contains the author's personal opinion and finding the circumstances that would make it possible to substitute detention in this particular case.
