Constitutional Adjudication in Poland and the Czech Republic: A Comparative Analysis

Abstract:

Předkládaná práce se věnuje ústavnímu soudnictví v Polsku a České republice v komparativním pohledu. Práce se v úvodu věnuje vymezení pojmu kontroly ústavnosti a následně představení některých modelů soudní kontroly ústavnosti. Skrze popis historického vývoje ústavního soudnictví v obou zemích práce sleduje důvody podoby současného ústavního soudnictví. Kromě toho je aktuální ústavní soudnictví analyzováno pomocí vymezení vybraných klíčových atributů. Poslední část práce je věnována judikatuře Ústavního soudu ČR a Ústavního tribunálu PR týkající se přezkumu pravomocí prezidenta, shromažďovacího práva a lustrace. Tato část je podrobená analýze a komparaci s důrazem na hledání příčin souladné či odlišné rozhodovací praxe ústavních soudů v těchto otázkách.

Abstract:

This thesis focuses on the comparison of the constitutional justice in Poland and the Czech Republic. In the introduction, the term 'control of constitutionality' is defined and, subsequently, certain models of judicial control of constitutionality are presented. Through a description of the historical development of the constitutional justice in both countries, the thesis investigates possible reasons for the similarities in their constitutional justices. In addition, constitutional justice is analyzed through demarcation of some key attributes. The last part of this thesis focuses on the jurisprudence of the Constitutional Court of the Czech Republic and the Polish Constitutional Tribunal, comparing the powers of the President, freedom of assembly and lustration. This part is subject to an analysis and comparison, with an emphasis on the reasons for similarities and differences in the decision-making of the constitutional courts.
