Práce se zabývá poučovací povinností soudu podle ustanovení § 118a o. s. ř. Cílem práce je nalézt vhodnou míru poučení, které se má účastníkům dostat, přičemž důraz je kladen na to, aby při poučení nedošlo k porušení zásady rovnosti stran a předvídatelnosti rozhodnutí jakožto součástí práva na spravedlivý proces. Abstract:
The thesis deals with the court‘s duty to instruct according to the article 118a Act No. 99/1963 Sb., code of civil procedure. The goal of this thesis is to find the accurate measure of instruction, which the participants should get considering the possible violation of the principles of equality of the parties and predictability of decision as a part of the right to a fair trial.
