Efficiency of Alternative Sentence to Community Service

Abstract:

Diplomová práce se zabývá alternativním trestem obecně prospěšných prací (OPP). Předkládá základní fakta, která se týkají ukládání, výkonu a realizace trestu obecně prospěšných prací. Představuje také Probační a mediační službu (PMS) a její odborné činnosti, zamýšlí se nad alternativními tresty či rozdíly restorativní a retributivní justice. Cílem výzkumné části práce je nalézt odpověď na otázku, zda je trest obecně prospěšných prací smysluplnou a efektivní sankcí. Mapuje, zda roste či klesá počet uložených trestů OPP a končí-li výkon těchto trestů v souladu s očekáváním, tzn. řádným vykonáním. Dalším cílem této práce je zjištění názoru samotných poskytovatelů místa pro výkon OPP na efektivitu tohoto trestu, zda energie vložená do realizace trestu je adekvátní skutečnému přínosu pro organizaci. Tato práce mapuje činnost v rámci výkonu trestu obecně prospěšných prací spadající do působnosti střediska PMS v Havířově

Abstract:

This dissertation deals with an alternative sentence to community service (CS). It presents the basic facts concerning the sentencing, prosecution and execution of the sentence to community service. The dissertation also presents the Probation and Mediation Service (PMS) and its professional activities, and considers alternative sanctions and/or differences in restorative and retributive judiciary. The aim of the research part of this dissertation is to find an answer to the question whether the sentence to community service represents a meaningful and effective sanction. It is being mapped whether the number of CS sentences imposed is increasing or decreasing and whether the execution of such sentences stays in line with expectations, i.e. is carried out properly. Another aim of this dissertation is to identify the CS execution area providers? view on efficiency of the penalty, whether the energy embedded in the punishment implementation is adequate to the real benefit for the organization. This dissertation maps the activities connected with the execution of the sentence to community work that are within the scope of PMS center in Havířov
