Solicitors and the Moravian Society in Years 1869-1914

Abstract:

Disertační práce se zaměřuje na dějiny advokátů na Moravě, jejich cestu k profesionalizaci a nezávislé profesi. Je vymezena roky 1869 a 1914 (mezi začátkem platnosti Advokátního řádu a začátkem 1. světové války), což je období označované jako „zlatý věk“ advokacie. Práce zkoumá život „řadového advokáta“ na Moravě – například jeho sociální původ, studium, přípravnou praxi a začátek vlastní samostatné činnosti, náboženství, jazyk, majetek či rodinu. Výzkum je založen na údajích ze čtrnácti rozličných moravských měst (umístěných v centru nebo na periferii, průmyslových či agrárních, rozvíjejících se nebo stagnujících). Oddíl nazvaný „Zrození advokáta“ se zabývá odpovědí na otázku, jaký typ praxe si koncipienti vybírali, pro jakého advokáta a jak dlouho pracovali; jestli si advokát vybíral svého koncipienta nebo naopak; jaký pobírali kandidáti advokacie plat, jaký typ bydlení si mohli dovolit a podobně. Podle memoárů měli koncipienti často finanční problémy a museli se uskromnit. Množství advokátů rychle rostlo navzdory všem problémům, které museli na své cestě k advokacii překonat a během 45 let vzrostl počet advokátů čtyřikrát. Nejvýznamnějším důvodem pro zvyšování počtu advokátů byl růst poptávky po právnických profesích. Moderní společnost nezbytně potřebovala osoby s velmi dobrou znalostí práva a kvalifikované k zastupování společností i jednotlivců ve všech typech případů nebo při jednání s úřady. Množství advokátů v jednotlivých regionech rostlo pochopitelně různě. Advokáti stáli v čele modernizace a byli počítáni mezi elitu moravské občanské společnosti. S tím je spojeno několik faktů: značná angažovanost ve veřejné sféře, velký vliv sekularizace, smysl pro moderní obchod a bydlení. Většina členů Moravské advokátní komory byla bohatá. Advokáti vlastnili rozsáhlé domy či byty a často měli několik příslušníků služebnictva. Autor zkoumal, odkud pramenil jejich majetek a jaká byla jeho struktura (nemovitosti, cenné papíry, hotovost apod.). Advokáti nevěnovali svůj čas pouze práci. Ve druhé polovině 19. století se významně zapojovali také do politiky – celostátní, zemské i regionální. Stávali se též představiteli hlavních moravských politických stran (např. Alois Pražák, Adolf Stránský, Eduard Sturm, Ludwig Czech). Podobně někteří význační advokáti zastávali posty starostů a členů samospráv moravských měst nebo představitelů nejrůznějších spolků. Poslední část je věnována historii, struktuře a personální skladbě Moravské advokátní komory.

Abstract:

This doctoral thesis deals with the history of advocates in Moravia, their way to the professionalization and the independence of their profession. It is marked by the years 1869 and 1914 (between the “Solicitor´s order” passing and the beginning of the World War I.), which is the period considered to be the “golden age” of advocacy. The thesis attempts to describe a life of a „regular“ advocate in Moravia – for example his social origin, study, practice and building of his own independent career, religion, language, property and family. The research is based on data from fourteen various Moravian towns (both central and on the periphery; industrial and agricultural; developing and stagnating). The chapter called „Birth of the Advocate“ answers questions as to what type of practice the articled clerks used to choose; what advocate they worked for and how long; whether an advocate used to choose his articled clerk or the opposite was true; what was the income of the articled clerks; what type of housing they could afford and so on. According to the memoirs, the articled clerks often had financial problems and had to eke out a living. The number of advocates grew quickly in spite of all problems they had to overcome on their way to advocacy and during the 45 years the number of advocates grew four times. The most important reason for this was the growth of demand for legal profession. Modern society urgently needed people with very good knowledge of the law and qualified to plead corporations or individuals at the bar in all sorts of cases or at dealing with authorities. The growth of number of advocates in particular regions obviously varied. Advocates were on the top of modernization and were considered to be the elite of the Moravian civil society. There are several facts related: great engagement in the public sphere, big influence of the secularization, sense for modern business and modern living. The majority of the Moravian Bar Association members was wealthy. Advocates owned large houses or flats and often had several servants. The author examines where they got their income from and what was their capital structure (properties, stocks, cash and so on). Advocates did not devote their time only to their work. In the second half of the 19th century they also became significantly involved in politics – state-wide, provincial or regional. They were leaders of the major Moravian political parties (e. g. Alois Pražák, Adolf Stránský, Eduard Sturm, Ludwig Czech), too. Similarly, some notable advocates became mayors or achieved leading positions in many Moravian towns and had outstanding positions in all sorts of associations. The last part of the thesis deals with the history, structure and personal composition of the Moravian Bar Association.
